SUBJECT:

Closure of a Portion of Lane South of 250 West 10th Avenue East from Alberta Street

RECOMMENDATION

COUNCIL POLICY

The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.

PURPOSE

The purpose of this report is to seek Council authority to close, stop-up and convey a portion of lane south of West 10th Avenue, east from Alberta Street.

BACKGROUND

The City acquired the said lane as a result of a conditional use development permit (DP92574). On May 4, 1982, subdivision Plan19327 was registered in the Land Title Office dedicating the said lane.

DISCUSSION

A prospective purchaser of the lands at 250 West 10th Avenue being the said Lot D has made an application to purchase the portion of lane that is excess to our needs.

The lane has never been opened and remains physically part of the south rear yard of said Lot D. The General Manager of Engineering Services has abandoned plans for a lane through this block. Further dedications will not be sought.

The Director of Real Estate Services has negotiated a sale of the 500 square feet (46.4 square metres) of lane as shown hatched on Appendix "A" for $60,000.00 Plus G.S.T. if applicable.

The Director of Real Estate Services advises that the sale price of $60,000.00 represents fair market value for the 500 square feet (46.4 square metres) of lane to be conveyed. The applicants will be responsible for all costs, plans, documents and Land Title Office fees required to complete the conveyance.

CONCLUSION

The General Manager of Engineering Services in consultation with the Director of Real Estate Services RECOMMENDS approval of the foregoing.
