First and Second Step ReportRECOMMENDATION
A. THAT petition projects listed in Appendix I be brought before a Court of Revision on February 11, 2004.
B. THAT the reports of the City Engineer and Director of Finance be adopted together with details of the Second Step Report as summarized in Appendix II. Source of funds for the total City's share of $1,248,860 is $34,006 from existing Engineering Basic Capital Accounts and $1,214,854 subject to approval of the 2004 Streets Basic Capital Budget.
C. THAT project Number 4, for pavement and curbs on Skeena Street from 27th Avenue to 28th Avenue, be brought before a Court of Revision on February 11, 2004, but that tree planting be excluded from this project.
D. THAT sidewalk projects Number 28 and 29 inclusive, as described in Appendix I, be designated as "pedestrian collector routes" so that the abutting residential property owners' rates are reduced by the required 25%.COUNCIL POLICY
Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure By-law.
PURPOSE
A Court of Revision is scheduled for February 11, 2004, at 7:30 p.m. to review a number of petition projects. This is the "First and Second Step" report for the petition projects. The purpose of this report is to begin the formal Local Improvement process by advancing the petition projects to the Court of Revision and to report on the financial arrangements for the projects. Approval of this report does not commit Council to undertake the projects.

shown on the attached schedule (Appendix I) are advanced to Council by Petition for review at a Court of Revision which will be held at 7:30 p.m. Wednesday, February 11, 2004.
Request for the deletion of Street Trees from Project Number 4, Pavement & Curbs, Local Residential
In 1991 Council approved a motion recommending that street tree planting be included in all residential and higher zoned street pavement and curb local improvements where possible. At its meeting of July 27, 1993, Council approved a mechanism for considering petitions with signatures from at least two-thirds of the property owners representing at least one-half of the actual property value supporting paving without tree planting.
A petition has been received for the installation of new pavement and curbs on Skeena Street from 27th Avenue to 28th Avenue. All of the eleven owners who properly signed the petition form indicated an opposition to tree planting. The Tax Department has reviewed the petition and advises the necessary two-thirds majority representing at least one-half of the actual property value has been acquired (10 required out of 14).
Recommendation "C" allows Council to decide on proceeding with this project subject to the Court of Revision on February 11, 200.
Lane Pavement
Property owners have been advised that the City is considering a "country lane" option but the property owners wish to proceed with the center strip and full width pavements included in this report.FINANCIAL IMPLICATIONS
Local Improvements
The cost of constructing the Local Improvement projects submitted in this report is estimated at $2.007 million. The City's share is $1.249 million funded as follows:
· $.034 million for the City's share of projects is available from existing Engineering Department Basic Capital Accounts as itemized in Appendix II
· $1.215 million is subject to approval of the 2004 Basic Streets Capital BudgetSecond Step
The Director of Finance reports as follows:
In accordance with the Local Improvements Procedure By-law, I am submitting the attached City Engineer's Report. The estimated cost of these Local Improvement projects is $2,007,255. The Property owner's share of these projects is $758,395. The City's share is $1,248,860. I have to report that the necessary financial arrangements can be made to carry out this work subject to approval of the 2004 Streets Basic Capital Budget.

The estimated costs provide for necessary incidental work. The cost of the property owner's share of the above noted projects and interest, is repayable over 15 years, except for lane lighting which is repayable over five years.
