Proposed Closure of a Portion of the South Side of Sixth Avenue West of Ash Street

 

RECOMMENDATION

COUNCIL POLICY

PURPOSE

The purpose of this report is to seek Council authority to close and stop-up, and convey a portion of the south side of Sixth Avenue, west of Ash Street.

BACKGROUND

On January 27, 1939, the City acquired the whole of Lot 7 through a tax sale. The South 10 feet and North 7 feet of said Lot 7 were subsequently established as lane and road respectively. The City sold the remainder of Lot 7 in April 1947. It is the North 7 feet of Lot 7 which is the subject of this report.

A redevelopment application has been received for the 200 foot by 110 foot site, being portions of Lots 7, 8, 9 and 10 at the southwest corner of Sixth Avenue and Ash Street. The redevelopment requires the North 7 feet of Lot 7 to be closed, stopped-up and conveyed to the owner of the development site.

DISCUSSION

In April 1996, portions of the City-owned lands on the north side of Sixth Avenue, east and west of Ash Street were dedicated for road, thereby satisfying the City's needs for additional road width on Sixth Avenue. That dedication rendered the subject portion of road to be closed, as surplus to the City's needs.

The redevelopment application has a condition, the dedication of the South 10 feet of Lots 8 and 9 for lane purposes. The proposed closure will result in the creation of a single lot, 200 feet by 110 feet, with all the future road and lane dedications complete.

The Director of Real Estate Services advises that the land exchange of the 32.5 square metre (350 square feet) of road for the 92.9 square metre (1000 square feet) of lane should proceed without further compensation to the City. The applicant will be responsible for all costs, plans, documents and Land Title Office fees required to complete the dedication and closure.

CONCLUSION

The present width of Sixth Avenue, west of Ash Street, is sufficient to meet the City's needs. The General Manager of Engineering Services in concurrence with the Director of Real Estate Services recommend that the 7 foot by 50 foot (350 square foot) strip of Sixth Avenue shown hatched on Appendix A, be closed, stopped-up and conveyed to the abutting owner, subject to the conditions set out in this report.
