SPECIAL COUNCIL MEETING MINUTES
NOVEMBER 5, 2002
A Special Meeting of the Council of the City of Vancouver was held on Tuesday, November 5, 2002, at 9:35 a.m., in Committee Room #1, Third Floor, City Hall, for the purpose of holding a Public Hearing to consider proposed amendments to the Heritage By-law and entering into a Heritage Revitalization Agreement.

THAT this Council resolve itself into Committee of the Whole, Deputy Mayor Sullivan in the Chair, to consider proposed amendments to the Heritage By-law and entering into a Heritage Revitalization Agreement.

1. Heritage Designation: 2733 Heather Street (Heather Pavilion)
An application by Mark Betteridge & Associates was considered as follows:
Summary: To designate Heather Pavilion at 2733 Heather Street to secure the long-term protection of the 1906 pavilion and the two end bays and towers of the 1908 addition.
The Director of Current Planning recommended approval.
Staff Comments
Gerry McGeough, Heritage Planner, was present to answer questions.
Summary of CorrespondenceCouncil received the following correspondence on this application:
1 letter in support of the application.
Speakers
Janet Anderson, Chair, Heather Heritage Society, spoke in support of the application and thanked Council and staff for encouraging the restoration proposal.
The Deputy Mayor called for any further speakers and none came forward.
Council Decision
MOVED by Councillor McCormick
A. THAT the 1906 Heather Pavilion and end bays and towers of the 1908 addition at 2733 Heather Street listed on the Vancouver Heritage Register in the "B" category be designated as a Protected Heritage Property; and
B. THAT the Director of Legal Services bring forward for enactment an amendment to the Heritage By-law.CARRIED UNANIMOUSLY
2. Heritage Designation: 640 West Pender Street (Bank of Montreal)
An application by Paul Merrick Architects Limited was considered as follows:
Summary: Heritage Revitalization Agreement and designation to authorize density bonus and secure the rehabilitation and the long-term protection of the "A" listed Bank of Montreal Building for use as the SFU Centre for Graduate Management Studies.
The Director of Current Planning recommended approval.
Staff Comments
Gerry McGeough, Heritage Planner, briefly reviewed the proposal and rationale for the recommended designation and HRA which authorizes a transferable density bonus and Development Cost Levy (DCL) relief and secures the rehabilitation and protection of the significant landmark as a public facility.
Summary of Correspondence
Council received the following correspondence on this application:

Speakers
Warren Gill, Vice President, University Advancement, SFU, spoke in support of the application, thanked Council and staff, and noted the restoration proposal would give SFU its third downtown core location.
The Deputy Mayor called for any further speakers and none came forward.
Council Decision
MOVED by Councillor Bass
A. THAT Council amend Schedule A of the Heritage By-law to designate the exterior and portions of the interior of the Bank of Montreal building at 640 West Pender Street as Protected Heritage Property;
B. THAT Council authorize the City to enter into a Heritage Revitalization Agreement for 640 West Pender Street to:
secure the rehabilitation, conservation and protection of the Bank of Montreal building;
vary Section 3 of the Downtown Official Development Plan By-law to permit a density bonus of 12 541 m2 (135,000 sq. ft.) to be transferred off-site; and
vary the Development Cost Levy from $26.91/m2 ($2.50/sq.ft.) to $0.11/m2 ($0.01/sq.ft.);AND THAT Council require an agreement providing that the density bonus not be available for transfer until the rehabilitation is complete, unless the owner(s) secure completion of the rehabilitation by a separate agreement and further that 1 393 m2 (15,000 sq.ft.) of the transferable density can only be used on property holdings of the current owner and will cease to be available if not utilized within four years of registration of the agreement;
AND THAT Council require a covenant to safeguard the building until it is rehabilitated;
AND THAT the agreements shall be prepared, registered and given priority to the satisfaction of the Directors of Planning and Legal Services.
