1. Dangerous/Nuisance Building at 2921 Kingsway

Vancouver City Council, at its meeting on September 12, 2002, declared the building and site at 2921 Kingsway a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter, and ordered the Registered owner of the property to demolish the building.

Subsequently, a letter dated September 30, 2002, addressed to Council was received from Mr. Sherman Lim, the owner, accompanied by a letter of the same date from Mr. Lim's contractor, Mr. Patrick McNamara, McNamara Construction Ltd. advising of work undertaken.

Staff have now inspected the site and advised of the need to bring this matter back to Council to address issues raised by Mr. Lim. A memorandum from staff will be circulated when available.

The relevant background material and letters referred to above are attached and refer.

NOTE FROM CLERK:

Section 10.1 of the Procedure By-law states no previous resolution of Council passed in the current term on any matter shall be rescinded unless by a vote of not less than two-third of the Council members present. The motion must be moved by a Council member who previously voted in the affirmative.

In addition, a new motion must be approved by a vote of not less than two-thirds of Council members present.
