A Special Meeting of the Council of the City of Vancouver was held on Thursday, December 16, 1999, at approximately 7:30 p.m. in Committee Room No. 1, Third Floor, City Hall for the purpose of liquor application/license review.

ADOPTION OF MINUTES
The minutes of the Vancouver Liquor Licensing Commission regular meeting held September 16, 1999, were approved as circulated.
1. 3681 West 4th Avenue - Jericho Pub Inc. File: 2615-16/RTS: 1093
Class 'D' Neighbourhood Pub - 20-Seat Patio
Council had before it an Administrative Report dated November 16, 1999 in which the Chief License Inspector submitted for consideration a request by Jericho Pub Inc. to amend the existing liquor license to add a 20-seat patio on private property at Jeremiah's neighbourhood Pub, 3681 West 4th Avenue, having considered the support of the majority of residents and business operators of the community.
Paul Teichroeb, Chief License Inspector, advised that, following discussion with the applicant, a deferral is being requested to provide time for the applicant to discuss concerns expressed with residents and business operators in the neighbourhood. Dennis Coates, agent for the applicant, concurred with this statement.

THAT Council defer the application by Jericho Pub Inc. in order to provide an opportunity for the applicant to confer with the neighbourhood regarding their concerns.

Class 'D' Neighbourhood Pub
Council had before it an Administrative Report dated November 16, 1999 in which the Chief License Inspector recommended Council endorse the request by 530077 B.C. Ltd. for a 65-seat Class 'D' Neighbourhood Pub at 870 Granville Street, having considered the support of the majority of residents and business operators of the community.
Guy Gusdal, License Coordinator, Property Use & Licence Division, reviewed the report.
Paul Teichroeb, Chief License Inspector, responded to questions relating to seating capacity and hours of operation in the Theatre Row Entertainment District (700, 800 and 900 blocks of Granville Street).

· the area needs this type of establishment with daytime hours
· noise would be contained within the building rather than outside
· the neighbourhood pub would enhance rejuvenation of the area; while the 800 and 900 blocks of Granville street are improving (credit in part to the re-opening of the Commodore), 700 blocks still needs a catalyst

· Geoff Edington, Business operator in area (Foghorn's Roadhouse)The speakers' points are summarized as follows:
· balance of seating capacity allotments seems to be shifting from smaller owner-operated establishments to larger cabarets, bars
· Foghorn's (900 block Granville Street) has applied recently for a Class 'D' license and concern is expressed that if the Commodore receives the seating allotment for a Class 'D' license, it will take a long time before another license becomes available
· this area is becoming a destination point and the neighbourhood pub concept is preferred to full restaurant facility; moving 65 seats from the 700 block allotment of seating would be detrimental to the overall allotment process
· endorsing this application would create an imbalance favouring the east side of the 800 block Granville StreetMOVED by Cllr. Tim Louis,
THAT Council endorse the request by 530077 B.C. Ltd., for a 65-seat Class D Neighbourhood Pub at 870 Granville Street, having considered the support of the majority of the residents and business operators of the community as determined by neighbourhood notification and subject to:
i) A Time-Limited Development Permit and/or Legal Agreement
ii) The signing of a Good Neighbour Agreement prior to issuance of the Business License.
iii) A Legal Agreement limiting the Class D Neighbourhood Pub seating to 65-seats despite any future changes to the Provincial Liquor Regulations.
iv) The hours of operation to be limited to 10:00 a.m. to 12:00 midnight Monday to Thursday, 11:00 a.m. to 1:00 a.m. Friday and Saturday and 11:00 a.m. to 12:00 midnight on Sunday.
v) No exotic entertainment.
