Local Improvement Reballots from June 22, 1999, Court of Revision

 

RECOMMENDATION

POLICY

Policies governing the Local Improvement Process are set out in the Vancouver Charter and the Local Improvement Procedure By-Law. The projects dealt with in this report have gone through the legal requirements in the process, but Council has requested additional information on project support/opposition through the reballot before giving final approval.

PURPOSE

At the June 22, 1999, Court of Revision, Council instructed staff to reballot five local improvement petition projects. Three projects have been dealt with on October 5, 1999, and the results of the remaining two projects are as follows:

Court 590, Item 45 Traffic Circle located at the intersection of 31st Avenue and Crown Street

Recommendation: Project not be approved

Number of owners 63
Required 2/3 majority 42

Based on the ballot results, there is insufficient support for this project to proceed.

Court 590, Item 46 Traffic Circle located at the intersection of 37th Avenue and Crown Street

Recommendation: Project not be approved

Number of owners 52
Required 2/3 majority 35

* Of the fourteen owners that did not respond eight signed the original petition. All of the fourteen owners were sent a second ballot and still did not respond.

Based on the ballot results and that eight of the owners signed the original petition, there is insufficient support for this project to proceed.
