Strata Title Conversion - 1098 Salsbury Drive

 

RECOMMENDATION

GENERAL MANAGER’S COMMENTS

COUNCIL POLICY

Council policy is reflected in the City’s Strata Title and Cooperative Conversion Guidelines, which outline factors which Council will consider in reviewing applications for converting previously-occupied buildings to strata title or cooperative ownership.

PURPOSE

Council approval is required for an application to convert the previously-occupied building at 1098 Salsbury Street (Parcel A, Block 30, D.L. 264A, Plan LMP37840) to strata title ownership.

BACKGROUND

The site is zoned RT-5 and is developed with a municipally-designated heritage building (formerly known as the Glen Hospital), built in 1908, which is listed as category “A” on the Vancouver Heritage Register. The location of the site is illustrated in Figure 1, below.

Pursuant to Development Permit No. DE402824 and Building Permit No. BU409660, the heritage building has undergone extensive renovations and alterations to convert the former care facility to a multiple conversion dwelling containing six dwelling units. According to the notarized declaration of the owner, the building has been vacant for approximately four years and has not been used as residential rental accommodation.

The conversion of the heritage building has occurred in conjunction with the comprehensive redevelopment of this site to also provide two infill one-family dwellings and two infill multiple dwellings, each containing four dwelling units. There are a total of 16 units now on site. On May 28, 1999, Council enacted By-law No. 7901, authorizing the Director of Legal Services to execute a Heritage Revitalization Agreement regarding this development, on behalf of the City. At that time, heritage designation was also considered and conferred.

On October 15, 1999, Occupancy Permit No. OC411056 was issued for the previously-occupied heritage building.

The applicant proposes to create a total of 16 strata lots. Pursuant to Section 9(1) of the Condominium Act, Council approval is required as it relates to the six strata lots proposed in the “previously-occupied” heritage building only.

STAFF ANALYSIS

In addition to Planning Department staff, the City Engineer and the City Building Inspector have reviewed this application. As the heritage building will contain only six dwelling units and was formerly in use as a care facility, not residential rental accommodation, the Manager of the Housing Centre has not been asked to comment.

The City Engineer has no dedication or servicing requirements for this site.

The City Building Inspector reports that based on the inspections that have been carried out and the issuance of an Occupancy Permit, this building substantially complies with all relevant City By-laws.

CONCLUSION

Based on the foregoing, and on the applicant’s compliance with the City’s Strata Title and Cooperative Conversion Guidelines, the Subdivision and Strata Title Coordinator supports this application.
