COUNCIL POLICY

Article 1.11.5.1 of the Building By-law prohibits the City Building Inspector from granting more than one extension to a Building Permit. Any further extensions can only be approved by City Council.

DISCUSSION

Building Permit No. BU402238 was issued for the construction of a new five-storey building at 75 East Pender Street with retail on the main floor, offices on the second through fourth floors and social club on the fifth floor with two levels of underground parking.

Construction was started on this project but has been discontinued for approximately two and a half years due to a legal dispute. Our Inspection Services confirm that the site is secure.

The permit has been extended three times by Council and expired on August 27, 1999.

It should be noted that the new Vancouver Building By-law will come into effect on November 1, 1999. The applicant for this extension (one of the owners) has been advised that this will be the last extension unless revised plans are submitted and approved under the new By-law provisions.

There has been no change to the zoning for this property (HA-1). Related Development Permit No. DE400001 has been extended to August 27, 2000.
