Re: ACOUSTIC REPORT FOR RESTAURANT
CLASS 2 APPLICATION 911 DENMAN STREET
The acoustic report submitted by BKL Consultants, June 16th, 1999 on behalf of the above application has been reviewed and the submission carefully weighted in context of the proposed use of the building and its proximity to residential premises.While the report accurately assesses the building in terms of its ability to contain certain entertainment type noise levels, it clearly establishes a limit to this capability.
The report states that a change in the music format to amplified dance or rock groups would result in substantial increases in overall noise levels and therefore a significant impact on the community.
The report assumes that music for this venue would be typically jazz music or the like and therefore manageable under the buildings assessed noise isolation class rating. (NIC) 50
I would submit that since jazz music is by no means of a uniform volume, there is potential for noise levels beyond the noise containment capability of the building.The report looks at the background noise levels in Denman Street and near the residential premises and suggest that the music levels emitted from the restaurant will be close to the background level of approximately 50 dBA.
While this is also correct it must be noted that the music level will not always be in sync with ambient noise, therefore, the music level must be expected to be below the background level at all times.

Recommendation
In view of the fact that the sound isolation capability of the building is limited and the restaurant is located close to residential accommodation, approval of the licence must be based on strict limit to the type of entertainment that can be provided and an undertaking by the applicant to contain the noise levels within the confines of the premises.
These provisions should extend to any subsequent ownership which is not subject to a full licence review.
The Health Board recommends acceptance of the acoustic report under the above conditions and with the expectation that all other recommendations by the report will be implemented.
