SPECIAL COUNCIL MEETING MINUTES - PARTIAL
APRIL 13 and MAY 6, 1999
A Special Meeting of the Council of the City of Vancouver was held on Tuesday, April 13,1999, at 7:30 p.m., in the Council Chamber, Third Floor, City Hall, for the purpose of holding a Public Hearing to consider proposed amendments to the Parking, Sign, Zoning and Development and Heritage By-laws, and a Heritage Revitalization Agreement. Subsequently the meeting was recessed, and reconvened in the Council Chamber, at 7:30 p.m. on Thursday, May 6, 1999, with the same members present, with the exception of Councillors Puil and Sullivan. The Minutes have been consolidated for ease of reference.

THAT this Council resolve itself into Committee of the Whole, Mayor Owen in the Chair, to consider proposed amendments to the Parking, Sign, Zoning and Development and Heritage By-laws, and a Heritage Revitalization Agreement.

1. Heritage Designation: 833-837 West 19th Avenue
An application by Paul Phillips, Environmental Design Group, was considered as follows:
Summary: The proposed amendment to Heritage By-law No. 4837 would designate the existing building, listed in the "C" category on the Vancouver Heritage Register, as a protected heritage property in return for an increase in the maximum floor area and the allowance to make an addition to an existing multiple conversion dwelling.
The Director of Community Planning, on behalf of Land Use and Development, recommended approval of the application.
Staff Comments
Yardley McNeill, Planner, reviewed the application and advised a petition previously received on this matter related specifically to RS-2 Zoning. Staff met with concerned residents, the majority of whom now support the application.
Applicant Comments
Paul Phillips, applicant, advised he had no comments to add and was available to answer questions.
Summary of Correspondence
There was no correspondence received on this application.
Speakers
Paul Eng, owner of property on west side of proposed development, expressed opposition to the application and relayed his concern with the proposed height and addition to the existing multiple conversion dwelling, which will effect a decrease of sunlight to his property.
The Mayor called for further speakers and none came forward.

Applicant Closing Comments
Mr. Phillips noted designation of the existing building will have less potential impact than construction of a new house. He further noted the heritage building will be completely restored.
Staff Closing Comments
Ms. McNeill clarified for Council that the heritage structure will continue to house two units once restored, not three, as suggested by the previous speaker.

A. THAT the property at 833-837 West 19th Avenue, listed as a "C" in the evaluation category on the Vancouver Heritage Register, be designated as a Protected Heritage Property.
B. THAT Council authorize the City to enter into a Heritage Revitalization Agreement to vary provisions of the Zoning and Development By-Law, as indicated under DE403434, thereby permitting:
· an increase in floor space ratio from the permitted .60 to the requested .87; and
· an addition to the existing Multiple Conversion Dwelling (MCD).C. THAT Council instruct the Director of Legal Services to bring forward for enactment an amendment to the Heritage By-Law, a By-law to authorize the Heritage Revitalization Agreement and a registered agreement to protect the building from vandalism and ensure its prompt restoration.

2. Rezoning: 1302-1322 East 12th Avenue
An application by Urban Design Group Architects Ltd. was considered as follows:
Summary: Proposal is to rezone from CD-1 (permits a multiple dwelling containing a maximum of 15 dwelling units) to RT-5N Two-Family Dwelling District.
The Director of Central Area Planning, on behalf of Land Use and Development, recommended approval.
Staff Comments
Marco D'Agostini, Planner, advised he was present to answer questions.
Applicant Comments
Lu Tang, Urban Design Group Architects Ltd., advised she had no comments at this time.
Summary of Correspondence
There was no correspondence received on this application.
Speakers
Eleanor Knox, resident of East 18th Avenue, expressed concern with rezoning the property to accommodate numerous multi-dwelling units, which could become the slums of tomorrow.
Audrey Gilmore, resident of East 11th Avenue, on behalf of the Neighbourhood Committee, advised of the need for more green space in the area and suggested only two duplexes be constructed, with additional green space added to the design. She advised Cedar Cottage Neighbourhood Association also favoured additional green space and landscaping.
The Mayor called for further speakers and none came forward.
Staff Closing Comments
Mr. D'Agostini advised the proposal was to downzone from fifteen to six units, to maintain consistency with the surrounding neighbourhood.
