A Regular Meeting of the Council of the City of Vancouver was held on Thursday, March 25, 1999, at 2:00 p.m., in Committee Room No. 1, Third Floor, City Hall, before the Standing Committee on Planning and Environment meeting, to consider By-laws and Motions.

At the Council meeting following the Standing Committee on Planning and Environment meeting earlier this day, there was not a sufficient quorum present to deal with the By-laws. Therefore, Council referred the By-laws and Motions on its agenda to this meeting, and agreed to deal with them as the first order of business.

The Mayor advised that the City Services and Budgets meeting on Thursday, April 1, 1999, scheduled for 9:30 a.m., would conflict with a function of the Greater Vancouver Transportation Authority.
Council agreed to reschedule the meeting for 2:00 p.m. on April 1, 1999.

APPROVAL OF MINUTES
The Minutes of the Standing Committee on Planning and Environment of February 25, 1999, were approved.

RECOMMENDATION
1. Sale of Meat and Dairy Products at East Vancouver Farmers' Market
File: 3501
The Committee had before it a Policy Report dated March 1, 1999 (on file), in which the Director of Environmental Health submitted for consideration a request from the organizers of the East Vancouver Farmers' Market Society to Vancouver City Council, dated October 13, 1998, to amend the food safety guidelines developed in conjunction with the Vancouver/Richmond Health Board to include the sale of meat and dairy products.
Domenic Losito, Director of Environmental Health, advised that safety of the food products is not an issue, and he would be prepared to approve the expansion under the conditions set out in the Policy Report. However, Council may wish to consider whether this change would affect nearby local merchants unfairly.
Devorah Kahn, East Vancouver Farmers' Market Society, spoke in favour of the sale of meat and dairy products from local producers. The market has never received complaints about competition from area merchants, and Ms. Kahn believed it more likely that the market enhances business by bringing more customers to the area.
Sydney Massey, area resident and Registered Dietitian, also spoke in favour. The Farmers' Market is an asset to the community, and provides access to a healthful variety of locally grown foods.
The following motion by Mayor Owen was put and carried. The Committee, therefore,
RECOMMENDED
THAT the East Vancouver Farmers' Market be permitted to include the sale of pre-packaged fresh meats and cheese products, from approved, government-inspected sources and that the Director of Environmental Health be requested to amend the Health Board's Farmers' Market Guidelines accordingly.

2. Proposed Greater Vancouver Regional Greenway Vision File: 5767
The Committee had before it a Policy Report dated March 9, 1999 (on file), in which the General Managers of Community Services and Engineering Services recommended thatCouncil adopt in principle the GVRD's Draft Greater Vancouver Regional Greenway Vision (on file), with the exception of the designation of environmental corridors in Vancouver. The General Managers also recommended that staff be directed to consult with the GVRD, neighbouring municipalities and other organizations to refine the Draft Greater Vancouver Regional Greenway Vision through their sub-regional sector planning processes.
Alan Duncan, Greenways Planner, reviewed the report and rationale for the recommendations, noting the difficulties which would be created by designating Environmental Corridors at this time. The GVRD has commented that the City's response is supportive, and will be pleased to work further with staff.
The following motion by Mayor Owen was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT the Draft Greater Vancouver Regional Greenway Vision be adopted in principle, except for the designation of Environmental Corridors in Vancouver, to guide sub-regional greenway sector planning.
B. THAT Vancouver greenway routes identified as Environmental Corridors in the Draft Greater Vancouver Regional Greenway Vision be included as components of the Recreational Network.
C. THAT staff be directed to consult with the GVRD, neighbouring municipalities and other organizations, as resources and civic priorities allow, to refine the Draft Greater Vancouver Regional Greenway Vision.

3. Nuisance Properties - 2410 East 19th Avenue and 2418 East 19th Avenue
File: 2701-1
The Committee had before it an Administrative Report dated February 19, 1999 (on file), in which the City Building Inspector recommended that Council declare the condition of the properties at 2410 and 2418 East 19th Avenue a nuisance, and order the owners to cut the overgrowth and remove the dismantled vehicles and all miscellaneous and discarded materials.
Michael Twynstra, Manager, Property Use Inspection, and Carlene Robbins, Manager, By-law Administration, reviewed the inspection history of the properties and rationale for the recommendations. It was noted that following Court proceedings, the owners were found guilty of non-compliance with the Untidy Premises By-law.
Mary Tataryn, property owner, and John Tataryn, son of the property owner, requested that Council allow until April 30, 1999 before issuing the order for clean-up. Poor health and involvement in a lawsuit regarding inheritance of the property have left them with limited time to do so fully, although some clean-up has been done. Mrs. and Mr. Tataryn also disputed that the condition of the property is as poor as alleged by City staff.
The following motion by Mayor Owen was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT Council declare that the condition of the properties at 2410 East 19th Avenue and 2418 East 19th Avenue (Lots 44 and 45, Block N, Sec 45, THSL Plan 11660) are a nuisance pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administrative Report dated February 19, 1999, and order the Registered owners of the properties to cut the overgrowth and remove the dismantled vehicles, miscellaneous items and discarded materials from the sites within 14 days of a copy of the Resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owners to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to cut the overgrowth and have the dismantled vehicles, miscellaneous items and discarded materials removed from the sites at the expense of the owners.

4. Nuisance Building - 1977 Harrison Drive File: 2701-1
The Committee had before it an Administrative Report dated March 10, 1999 (on file), in which the City Building Inspector recommended that City Council declare the building and accessory building at 1977 Harrison Drive a nuisance and order the owner to remove the buildings and all demolition debris. It was also recommended that a 336D Notice be filed against the Title to the property in order to warn any prospective purchasers ofCouncil's order.
Peter Sweeney, Manager, Building Inspection, briefly reviewed the history of inspections and orders in connection with this building.
The Chair enquired whether anyone wished to speak on behalf of the property owner, but no one came forward.
The following motion by Councillor Bellamy was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT Council declare that the building and accessory building at 1977 Harrison Drive (Lot 18, Block 21, District Lot Fraserview) are a nuisance pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administrative Report dated March 10, 1999, and order the Registered Owner of the property to remove the building and accessory building and all demolition debris from the site within 14 days of a copy of the Resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the building and accessory building and all demolition debris removed at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 1977 Harrison Drive, in order to warn prospective purchasers that as a result of the condition of the buildings and Council's Resolution, the purchaser could suffer significant expense if the order of Council were enforced against him.
