M.V. Magic Moment - David C. Kane
Class `A' (Motor Vessel) Liquor License

RECOMMENDATION

GENERAL MANAGER'S COMMENTS

COUNCIL POLICY

There are no Council policy or guidelines regarding new liquor license applications for motor vessels.

PURPOSE

David C. Kane is requesting a Council resolution endorsing his application for a Class `A' (Motor Vessel) liquor license on board the M.V.Magic Moment.

BACKGROUND

Since 1989, the Vancouver Liquor Licensing Commission, and ultimately City Council, has considered applications for Class `A' (Motor Vessel) liquor licenses. During the review and discussion of the applications, it was determined that because liquor could only be served while the motor vessel is at sea, it likely would not impact on the surrounding neighbourhood. Therefore, applications were endorsed without a mail notification or a referendum.

Magic Moment is an 86-foot vessel registered by Transport Canada to carry 75 persons and has completed federal requirements for a charter vessel. The vessel is docked at the Bayshore Marina and offers high-end cruises ranging from three to five hours. The majority of cruises take place in the evenings and never return to the marina past 12:00 midnight.

The yacht has a complete galley, but no meals are prepared on board. Food is catered by the Westin Hotel and prepared in the hotel's nearby kitchens and brought on board in hot-trucks. If occasionally other caterers are used, they are asked to prepare the food off the vessel and to use food warmers. Mr. Kane has provided a copy of the Food Service Permit, issued by the B.C. Ministry of Health.

There is ample nearby parking and public transportation to support the application.

COMMENTS

The Police Department supports this application. The Marine Squad advises that Mr. Kane has been chartering full time for approximately eight years without any complaints, and the entire crew is qualified to handle any marine emergency. Charters do not focus on the service of liquor and ample space and consideration is devoted to also providing non-alcoholic beverages.

The Environmental Health Division of the Vancouver-Richmond Health Board has no objection to this application.

CONCLUSION

As a Class `A' (Motor Vessel) liquor license is unlikely to impact on the neighbourhood, staff recommends the application be endorsed.
