A Regular Meeting of the Council of the City of Vancouver was held on Thursday, January 28, 1999, at 10:45 a..m., in Committee Room No. 1, Third Floor, City Hall, following the Standing Committee on City Services and Budgets meeting, to consider the recommendations of the Committee.

ADOPTION OF MINUTES
The Minutes of the Standing Committee on City Services and Budgets of January 7, 1999, were adopted.
RECOMMENDATION
1. 1999 Consolidated Assessment Roll File: 1551
David Highfield, Area Assessor, BC Assessment Authority, made a presentation on the assessment trends reflected in the 1999 Consolidated Roll (City of Vancouver 1999 Assessment Roll Report dated January 15, 1999, on file in the City Clerk's Office). Some of the items discussed were:
· legislative changes and selected case law examples;
· percentage of total roll by property class;
· new construction and development;
· market movement and market changes from 1997 to 1998;
· the basis for assessments carried out on leased properties, including those on City-owned and First Nations Reserve lands;
· equity issues.
In addition to Mr. Highfield, David Lee, Deputy Assessor, and Stephen Kelly, Senior Supervisor Assessor, responded to questions from Committee members.
Ken Bayne, Comptroller of Budgets and Research, also responded to questions.
The following motion by Councillor Bellamy was put and carried. The Committee, therefore,
RECOMMENDED
THAT the presentation on the 1999 Consolidated Assessment Roll be received for information.

2. Warning to Prospective Purchasers of 3287 East 26th Avenue File: 2701-1
The Committee had before it an Administrative Report dated January 12, 1999 (on file), in which the City Building Inspector recommended that a 336 D Notice be filed against the Certificate of Title to the property at 3287 East 26th Avenue. The General Manager of Community Services recommended approval, as reflected in the recommendations of this report.
Peter Sweeney, Manager of Building Inspection, briefly reviewed the history of infractions pertaining to this property. Mr. Sweeney also noted that staff have requested Legal Services staff to pursue an injunction, and requested that Council instruct the Director of Legal Services to proceed accordingly.
The following motion by Mayor Owen was put and carried. The Committee, therefore,
RECOMMENDED
THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the Property at 3287 East 26th Avenue, in order to warn prospective purchasers that there is a contravention of the Zoning and Development and Vancouver Building By-laws related to this building;
AND THAT the Director of Legal Services be instructed to commence injunction proceedings to obtain compliance with City by-laws at this address.

The Committee had before it an Administrative Report dated January 12, 1999 (on file), in which the City Building Inspector recommended that a 336 D Notice be filed against the Certificate of Title to the property at 3275 Marmion Avenue. The General Manager of Community Services recommended approval, as reflected in the recommendations of this report.

Mr. Sweeney also noted that staff have requested Legal Services staff to pursue an injunction, and requested that Council instruct the Director of Legal Services to proceed accordingly.
