SUBJECT:Local Improvement Reballots from February 3, 1998 Court of Revision

RECOMMENDATION

A.THAT Court #582, Item #004 BE APPROVED for lane lighting on the lane east of Elgin Street from the lane south of 31st Avenue to the lane north of 33rd Avenue.

B.THAT Court #582, Item #041 BE APPROVED for lane pavement on the lane east of Elgin Street from the lane south of 31st Avenue to the lane north of 33rd Avenue and the lane south of 31st Avenue from Elgin Street to Ross Street.

C.THAT Court #582, Item #052 BE APPROVED for lane pavement on the lane south of 10th Avenue from Windsor Street to St. Catherines Street.

COUNCIL POLICY

Policies governing the Local Improvement Process are set out in the Vancouver Charter and the Local Improvement Procedure By-Law. The projects dealt with in this report have gone through the legal requirements in the process, but Council has requested additional information on project support/opposition through reballots before giving final approval.

PURPOSE

At the February 3, 1998 Court of Revision, Council instructed staff to reballot these local improvement petition projects.

This has been done and the results are as follows:

Court #582, Item #004, Lane Lighting on the lane east of Elgin Street from the lane south of 31st Avenue to the lane north of 33rd Avenue

Required 2/3 majority 20

Ballot results: In Favour 21

Opposed 2

Responses 23

Based on the ballot results, there is sufficient support for this project to proceed.

Recommendation: Approve.

Court #582, Item #041, Lane Pavement on the lane east of Elgin Street from the lane south of 31st Avenue to the lane north of 33rd Avenue and the lane south of 31st Avenue from Elgin Street to Ross Street

Based on the ballot results, there is sufficient support for this project to proceed.

Ballot results: In Favour 16

Opposed 2

Responses 18

The eight owners who did not return their ballots were sent a second ballot and still did not respond. Of these eight owners, six had signed the original petition. If these owners are assumed to be in favour, there is sufficient support for this project to proceed.

Recommendation: Approve.
