SUBJECT:Local Improvements Flat Rates and Projects to be Cancelled

RECOMMENDATION

A.THAT the flat rates shown on the "List of Projects Completed in 1997", on file in the City Clerk's Office be approved.

B.THAT previously approved projects numbered Court #530, Items #102 and #103, and Court #537, Items #118 and #123 and Court #547, Items #68 and #69 and Court #550, Items #96, #98, #99 and #100 and Court #555, Items #90 and #91 and Court #565, Items #56, #57, #58, and #60 and Court #570, Item #49 and Court #574, Item #71, as described in detail in the body of this report, be cancelled.

COUNCIL POLICY

Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure by-law.

Clause 51B of the Local Improvements Procedure By-law provides that, by resolution, Council may establish a flat rate per foot frontage with respect to any two or more projects of a like nature, based on the average cost per foot frontage of such projects, as established by Council.

PURPOSE

This report requests Council approval of flat rates to be charged to property owners for their share of local improvement projects completed in 1997. These rates will be used for local improvement billings to be sent out in March 1998.

DISCUSSION

For the Local Improvement projects completed in 1997, flat rates have been derived from contract costs and the cost of work done by City forces, together with other general expenses and an allowance for interest over the construction period.

These flat rates have been developed in accordance with the provisions of the Vancouver Charter and the Local Improvement Procedure By-law; they do not exceed by more than the allowable 10% the estimated rates approved by Council in the respective Second Step reports for each Court of Revision.

The applicable rates are shown on the "List of Projects Completed in 1997" on file in the City Clerk's Office.

Projects to be Cancelled

There are 18 speed deterrent ramp projects approved at previous Courts of Revision, where no specific ramp locations satisfactory to the adjacent property owners could be found despite considerable discussions with the property owners. These discussions were held between two and eight years ago and there have been no subsequent inquiries expressing interest in installing the ramps. As these projects are not proceeding, the accounts should be closed off.

If at some future date property owners request installation of speed humps, and satisfactory locations can be found, we will then ballot all the owners to see if there is a two-thirds majority of support for the project rather than have someone circulate a petition again.
