2104 East 19th Avenue - Proposed Closure of a Portion of the Lane, South of 19th Avenue, East of Marshall Street.



RECOMMENDATION

THAT Council close, stop-up and convey to the abutting owner, those portions of the lane south of 19th Avenue, east of Marshall Street, shown hatched on the plan attached as Appendix "A", subject to the following conditions:

1.The applicant to pay $69,000 plus G.S.T., if applicable, as the value for the 141 square metre (1517 square feet) portions of lane to be closed, in accordance with the recommendation of the Manager of Real Estate Services.

2.The portions of lane to be closed are to be consolidated with the abutting lands, to form two parcels, the same as shown within the heavy outline on the plan attached as Appendix "A".

3.The abutting owner to be responsible for any necessary plans and documents.

4.The abutting owner to be responsible for the costs (estimated at $1,000) to relocate the catch basin that presently drains the lane, to the portion of the lane to remain open; to the satisfaction of the General Manager of Engineering Services.

5.The abutting owner to be responsible for the cost of relocating any existing utilities that encroach onto the portions of lane to be closed or for the provision of a right-of-way to contain the utilities, each to the satisfaction of the General Manager of Engineering Services.

6.Any agreements are to be to the satisfaction of the Director of Legal Services.

7.No legal right or obligation shall be created hereby and none shall arise hereafter until the documents are executed.

COUNCIL POLICY

The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.

PURPOSE

The purpose of this report is to seek Council approval to close, stop-up and convey to the abutting owner, (two) portions of the lane south of 19th Avenue, east of Marshall Street, that are no longer required for lane purposes.

DISCUSSION

The property at 2104 East 19th Avenue is comprised of two legal lots being Lot 17 and Lot 18, both of Blocks 17 and 18, District Lot 195, Plan 2002. There is a single dwelling that presently occupies both lots. The lots have the same owner. The owner proposes to redevelop the properties and has applied to purchase an approximate 23 foot by 66 foot strip of lane (1517 square feet) at the rear of Lots 17 and 18. The present width of the "lane" at this location is 43 feet, and our requirement is only 20 feet. Therefore, the 23 foot by 66 foot strip is surplus to our needs and could be closed, stopped-up and sold to the abutting owner. The present lane was dedicated as "road" by the deposit of Plan 15146, in November of 1973.

The abutting owner wishes to retain two individual lots, and as such, the portions of lane to be closed will individually be consolidated with the abutting Lot 17 and Lot 18.

An inspection has identified that there is a catch basin and utility lines that may encroach onto the portions of lane to be closed. The applicant will be responsible for determining whether the catch basin and utilities encroach onto the portions of lane to be closed and will be responsible for the costs of relocation, if required, or the provision of a right-of-way, to the satisfaction of the General Manager of Engineering Services.

CONCLUSION

The present width of the subject lane is greater than our requirements. We recommend that the approximate 141 square metre (1517 square feet) portions of lane that are in excess of our requirements, be closed stopped-up and sold to the abutting owner, subject to the conditions set out in this report.
