A Special Meeting of the Council of the City of Vancouver was held on Tuesday, October 28, 1997, at 7:30 p.m., in the Council Chamber, third Floor, City Hall, for the purpose of holding a Public Hearing to consider proposed amendments to the Heritage By-law.

1. Heritage Designation: 1101 Nicola Street
(Queen Charlotte Apartments)
An application by Strata Corporation VR900 was considered as follows:
If approved, the proposed Heritage By-law amendment would:
-designate the existing building (Queen Charlotte Apartments), listed in the 'B' evaluation category on the Vancouver Heritage Register, as a protected heritage property on a voluntary basis.
The Director of Community Planning recommended approval of the application.
Staff Comments
Gerry McGeough, Heritage Planner, advised the 25 strata-owners in the building have voluntarily requested heritage designation. Staff fully endorse the designation.

Paul McLauchlan, Chair, Strata Council for 1101 Nicola Street, advised he was present to answer questions.

2. Heritage Designation: 570 West 7th Avenue
(James Shaw House)
An application by Cressey Development/James Hancock, Architects, was considered as follows:
If approved, the proposed Heritage By-law amendment would:
-designate the existing building (James Shaw House), listed in the 'B' evaluation category on the Vancouver Heritage Register, as protected heritage property; and
-be in exchange for relaxation of the following Central Broadway C-3A Urban Design Guidelines: maximum conditional height from 27.4 m (90 ft.) permitted to 32.6 m (107 ft.) proposed; provision of open space; and a partial fifth storey podium.
The Director of Community Planning recommended approval of the application.
Staff Comments
Gerry McGeough, Heritage Planner, advised staff fully support the designation. He also advised, at the request of the applicant, there is a slight change to Recommendation B in the report before Council. The applicant would like a delay in the enactment of the by-law to designate the building until the Development Permit Board's environmental conditions have been met.

B.THAT the Director of Legal Services bring forward for enactment an amendment to the Heritage By-law, once the Director of Planning is satisfied that the Development Permit Board's environmental conditions have been met.

An application by The Larch Street Partnership/Brook Development Planning/Ramsey Worden Architecture was considered as follows:
If approved, the proposed development would:
-designate the existing building, listed in the 'B' evaluation category on the Vancouver Heritage Register, as protected heritage property as a condition of the rezoning of 5338-5490 Larch Street from RS-1 to CD-1.
The Director of Community Planning, on behalf of the Director of Land Use and Development, recommended approval of the application.
Staff Comments
Gerry McGeough, Heritage Planner, advised staff fully support the heritage designation. Mr. McGeough noted the by-law for 5338 Larch Street will be amended to show the heritage designated building as number 133 instead of 134 in the Heritage By-law, because the by-law enactment for the building at 570 West 7th Avenue will not be proceeding this evening.
