   SUBJECT:  License Agreement  for Pedestrian  Pathways at Ann  Street and
             Aberdeen Street


   RECOMMENDATION

        THAT Council authorize the Director of Legal Services to enter into
        a  licence agreement with  B.C. Hydro for  pedestrian pathways over
        the  Central Park Corridor, north  of Vanness Avenue  at Ann Street
        and Aberdeen Street.


   COUNCIL POLICY

   On  June 24, 1993, Council  approved the rezoning  of 3400-3660 Vanness,
   Foster and Euclid Avenues (Collingwood Village).

   PURPOSE

   This  report seeks Council authority  to enter into  a licence agreement
   with BC Hydro for the operation of two pedestrian pathways at Ann Street
   and Aberdeen Street.

   BACKGROUND

   In order to  fulfil a  prior-to enactment condition  of the  Collingwood
   Village  rezoning, the developer entered into an agreement with the City
   to construct two pedestrian  pathways at Ann Street and  Aberdeen Street
   over the BC Hydro owned Central Park corridor at no cost to the City.

   Upon completion of the pathways, the City will  operate and maintain the
   pathways.   Requests  for a  registered right-of-way  over the  lands in
   favour of the City  has been refused by BC Hydro, but instead, they have
   offered a twenty-year licence agreement for the pedestrian pathways.


   DISCUSSION

   In developing the street  and pedestrian pathway network for  this site,
   two pedestrian  pathways were  identified at  Ann  and Aberdeen  Streets
   (Appendix A) to  link the existing neighbourhood to the  north, which is
   separated by  the  Skytrain line  and  the Molson  Parkway, to  the  new
   neighbourhood.  These pathways provide improved access for  the existing
   community to  the  new  facilities  provided  through  the  rezoning  of
   Collingwood  Village.     These   facilities  include  three   parks,  a
   neighbourhood house, a school site, and a daycare facility.

   Staff  recommend that the City  secure these pathways  through a licence
   agreement.

   FINANCIAL IMPLICATIONS

   There are  no  short term  financial  costs  as the  developer  will  be

   responsible  for all  costs involved  with the  construction of  the two
   pedestrian  pathways.    BC Hydro  has  agreed  to  provide the  licence
   agreement to the City for a nominal annual fee.   Upon completion of the
   pathways, the City will be assuming ownership, liability and maintenance
   obligations for the pathways.
