                           SPECIAL COUNCIL MEETING


        A Special Meeting of the Council of the City of Vancouver was  held
   on Tuesday,  October 17,  1995 at  2:05  p.m., in  the Council  Chamber,
   third floor, Vancouver  City Hall, for the  purpose of holding  a Public
   Hearing to consider proposed amendments to the Heritage By-law.

             PRESENT:  Mayor Owen
                       Councillors Bellamy, Chiavario, Clarke, Hemer,
                                   Ip, Kwan, Price, Puil and Sullivan

             ABSENT:   Councillor Kennedy

   COMMITTEE OF THE WHOLE

   MOVED by Cllr. Bellamy,
   SECONDED by Cllr. Hemer,
        THAT  this  Council resolve  itself  into Committee  of  the Whole,
   Mayor  Owen  in the  Chair,  to  consider  proposed  amendments  to  the
   Heritage By-law.

   1.   225-255 East Broadway
        (Lots 12 to 16 except part in Explanatory
        Plan 3324, all of Block 52, District Lot
        200A, Plan 708) (Vernon Building)        

        An  application  by  KCC   Investments/Jan  Timmer  Architect   was
   considered as follows:

        The proposed amendment to the Heritage By-law would:

        -    designate  the  principal  facades  of  the  existing building
             listed  in  the  "C"  evaluation  category  on  the  Vancouver
             Heritage Register as a protected heritage property;

        -    ensure  the  protection  of  the  designated  portions  of the
             building  from inappropriate alterations and demolition in the
             future; and

        -    be in  exchange for  approval of  a relaxations  to the  floor
             space ratio  from 3.0 FSR to 3.73 FSR,  the rear yard setback,
             nine  parking  spaces, and  loading  access to  one commercial
             unit which the Director  of Land Use  and Development is  able
             and prepared to support.


        The  Director of  Land Use and  Development recommended approval of
   this application.


   Staff Comments

        Mr.  Marco D'Agostini,  Heritage Program  Assistant, advised  staff
   have not received any objections to this application.


   Summary of Correspondence

        There was no correspondence received on this application.


   Speakers

        The  Mayor called for speakers for and  against the application and
   none were present.


   MOVED by Cllr. Bellamy,

        A.   THAT Council  supports a  floor space  relaxation of  465.2 m›
             (5,008 sq.ft.)  from  3.0  FSR to  3.73  FSR  as  proposed  in
             Development Application DE400089.

        B.   THAT  Council  approves  the  designation   of  the  principal
             facades  of the  Vernon  Building  at 225-255  East  Broadway,
             listed  on  the   Vancouver  Heritage  Register  in   the  "C"
             evaluation category, as a Protected Heritage Property.

   MOVED by Cllr. Bellamy,
        THAT the Committee of the Whole rise and report.

   SECONDED by Cllr. Hemer,
        THAT the report of the Committee  of the Whole be adopted, and  the
   Director of Legal Services  be instructed to  prepare and bring  forward
   the necessary by-law amendments.
