RECOMMENDATION
A. THAT petition projects listed in Appendix I, except for
project Number 21, be brought before a Court of Revision on
November 16, 1995.
B. THAT the reports of the City Engineer and Director of Finance
be adopted, together with details of the Second Step Report as
summarized in Appendix II.

D. THAT sidewalk projects Numbered 26-30 inclusive, as
described in Appendix I, be designated as "pedestrian
collector routes" so that the abutting property owners' rates
are reduced by the required 25%.
COUNCIL POLICY
Policies governing the Local Improvement Process are set out in the
Vancouver Charter and the Local Improvement Procedure By-Law.
PURPOSE
A Court of Revision is scheduled for November 16, 1995 at 7:30 p.m., to
review a number of petition and initiative projects. This is the "First
and Second Step" report for the petition projects. The report for
initiative projects was approved by Council on September 12, 1995. The
purpose of this report is to begin the formal Local Improvement process
by advancing the petition projects to the Court of Revision and to
report on the financial arrangements for the projects. Approval of this
report does not commit Council to undertake the projects.
First Step
As required by the Local Improvement Procedure By-Law, projects for:

II. Pavement & Curbs, Local Residential
III. Pedestrian Collector Sidewalks
IV. Sidewalks
V. Lane Pavement, Higher Zoned
VI. Lane Pavement, Local Residential
VII. Speed Humps

shown on the attached schedule (Appendix I) are advanced to Council by
Petition for review at a Court of Revision which will be held at 7:30
p.m., Thursday, November 16, 1995.
Drainage Prior to Paving
In addition to construction of the petition paving projects, advance
drainage work involving installation of catch basins and storm drains
must first be carried out. Based on past experience, we estimate the
cost of this work to be in the order of $50,000.
This drainage work is not directly related to the street and lane
construction, however, it should be done now in order not to delay the
construction, and so that the newly paved streets and lanes will not
have to be dug up to accommodate the drainage work in the future. The
work involves installation of permanent facilities to replace temporary
drains and should be done whether or not the paving proceeds.
The location and individual costs of this work will be reported in a
subsequent Manager's Minute upon completion of the necessary design
work.
Request for the deletion of Street Trees from Project Number 21
Pavement and Curbs, Local Residential
In 1991, Council approved a motion recommeding that street tree planting
be included in all residential and higher-zoned street pavement and
curbing local improvements, where possible. At its meeting of July 27,
1993, Council approved a mechanism for considering petitions with
signatures from at least two-thirds of the property owners representing
at least one-half of the actual property value supporting paving without
tree planting.
A petition has been received for the installation of new pavement and
curbs on Windermere Street between 22nd Avenue and 23rd Avenue. All of
the six property owners who properly signed the petition form indicated
an opposition to tree planting. Their reasons vary from sap falling on
their cars, to raking leaves each fall, and obstruction of their views.
The Tax Department has reviewed the petition and advises the necessary
two-thirds majority representing at least one half of the actual
property value has been acquired (6 required out of 9).
Recommendation "C" allows Council to decide on proceeding with this
project.
Capital Funds
Funds for the City's share of these projects are available from existing
Streets Basic Capital Unappropriated Accounts or are subject to approval
of the 1996 Streets Basic Capital Budget and Park Board Capital Budget.
Second Step
The General Manager, Corporate Services reports as follows:
In accordance with the Local Improvements Procedure By-Law, I am
submitting the attached City Engineer's Report. The estimated cost of
these projects is $1,404,156. The property owners share of these
projects is $587,071. The City's share is $809,211. The Park Board
share for reliefs related to street tree planting is $7,874. I have to

report that the necessary financial arrangements can be made to carry
out this work subject to Council approval of the Streets and Park Board
1996 Capital Budget.
