THAT Council approve in principle the offer of payment-in-lieu in the amount of $120,000 by Live Entertainment of Canada Inc. for DE 400420, for the waiver of 10 parking spaces required by the approved DP 216461; and B. THAT the Director of Legal Services be requested to bring forward a by-law to amend Schedule A of the Parking By-law pursuant to Section 4.11.5 to effect this waiver. COUNCIL POLICY In 1986, Council approved payment-in-lieu parking provisions. PURPOSE An application pursuant to Section 4.11 of the Parking By-law has been received to waive the number of parking spaces required by the approved DP 216461 and to make payment-in-lieu. The particulars of the application are as follows: Address: 799 Homer Street Applicant: Jim Moodie Consultants for Live Entertainment of Canada Inc. Zoning: DD DE No. 400420 Type of Development: New performing arts theatre Use: Theatre (6,038 m›) Legal Description: Lot F, Block 55, Plan LMP17405, District Lot 541 - 2 - Parking Required: 25 (10 full-time plus 15 during (theatre staff) matinees) Parking Provided: 0 No. of Spaces for Payment-in-Lieu: 10 Recommended Amount/Space: $12,000 Total Payment-in-Lieu Amount: $120,000 A review of this application found that an off-site parking covenant was required due to site constraints for 10 full-time parking spaces for theatre staff and 15 part-time parking spaces for theatre staff during matinees. The applicant has had difficulty in securing a parking covenant, therefore; payment-in-lieu is an appropriate alternative for the 10 full-time staff spaces. The value of pay-in-lieu is based on the value at the date of the original Development Permit approval. Once the pay-in-lieu bylaw is approved and the applicant makes the contribution, the requirement for the parking covenant for 10 full-time staff parking spaces will be waived. For Council's information, Live Entertainment of Canada Inc. has also asked that the requirement for the 15 part-time spaces be waived. The Library Square parkade, which has surplus parking for its needs, should be able to accommodate the short-term parking needs of theatre staff during matinees, though they would compete with general public demands. This has been approved by the Director of Land Use and Development in consultation with the General Manager of Engineering Services. In addition, Live Entertainment of Canada Inc. will be advertising the Library Square parkade on their theatre tickets. * * * * *
