SUBJECT: 3005 East 51st Avenue Proposed Closure of
a Portion of the Lane North of East 51st
Avenue, East of Lancaster Street
RECOMMENDATION
THAT Council close, stop-up and convey, to the abutting owner, that
portion of the lane north of East 51st Avenue, east of Lancaster
Street, shown hatched on the plan attached as Appendix "A", subject
to the following conditions:
a) The portion of lane to be closed to be consolidated with the
abutting Lot 1, Block 3, South East 1/4 of District Lot 337,
Plan 9069, to the satisfaction of the Director of Legal
Services.
b) The abutting owner to pay $23,000, plus G.S.T. if applicable,
as the value for the 336 square foot portion of lane to be
closed in accordance with the recommendation of the Manager of
Real Estate.
c) The abutting owner to be responsible for any necessary plans
and documents.
d) Any agreements are to be to the satisfaction of the Director
of Legal Services.
e) No legal right or obligation shall be created and none shall
arise hereafter until the documents are executed.
If Council approves this report, the Formal Resolution to close this
lane will be before Council later this day for approval.
COUNCIL POLICY
The authority for closing and disposing of portions of streets and lanes
is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to obtain Council approval to close, stop-
up and convey to the abutting owner, a portion of the lane, north of
East 51st Avenue, east of Lancaster Street.
DISCUSSION
An application has been received to purchase the 10 feet of lane shown
hatched on the plan hereto attached as Appendix "A", and abutting Lot 1,
Block 3, South East 1/4 of District Lot 337, Plan 3069 (3005 East 51st
Avenue). The present width of the lane is 30 feet at this location and
our requirement for this lane is only 20 feet. Therefore, the residual
strip, 10 feet in width, on the north side of Lot 1 (336 square feet) is
no longer required for lane purposes and could be closed, stopped-up and
sold to the abutting owner.
The owner of Lot 1 (3005 East 51st Avenue) has agreed to pay $23,000,
plus G.S.T., if applicable, for the 336 square feet of lane to be
closed. The portion of lane to be closed will be consolidated with the
abutting Lot 1 to form a single parcel, to the satisfaction of the
Director of Legal Services. The abutting owner is to be responsible for
all plans and documents.
