   SUBJECT:  Strata Title Conversion: 3727 Main Street

   RECOMMENDATION

        THAT the application to convert the previously-occupied building at
        3727 Main Street  (Lot 12, Block 3,  D.L. 629, Plan 483)  to strata
        title  ownership be  approved  in principle,  but that  pursuant to
        Section  9(1) of the  Condominium Act, the  Certificate of Approval
        (Form 10)  shall not be  issued unless the following  condition has
        been met within one year of the date of this approval:

             Completion  of all  work required  by  the City  Building
             Inspector, under  the required permits, at no cost to the
             City,  in order  that  this previously-occupied  building
             substantially complies with all relevant by-laws.

   GENERAL MANAGER'S COMMENTS

        The  General Manager of  Community Services RECOMMENDS  approval of
        the foregoing.

   COUNCIL POLICY

   Council Policy is  reflected in the City's Strata  Title and Cooperative
   Conversion Guidelines, which  outlines factors Council will  consider in
   reviewing applications  for converting previously-occupied  buildings to
   strata title or cooperative ownership.

   PURPOSE

   Council  approval   is  required  for  an  application  to  convert  the
   previously-occupied building at 3727 Main Street, (Lot 12, Block 3, D.L.
   629, Plan 483) to strata title ownership.
   BACKGROUND

   The  site is  zoned C-2  and is  developed with  a two-storey  mixed-use
   retail/residential  building.   The  ground floor  of  the building  was
   constructed in 1958.  A two-storey addition to the rear of  the existing
   building was  constructed in  1963, and subsequently  added to  in 1984.
   The building was  substantially upgraded and renovated in  1992 to allow
   for 2 retail  units on  the ground  floor and  2 dwelling  units on  the
   second floor.

   The owner proposes to create 2 commercial strata lots and  2 residential
   strata  lots.   The building  is  presently occupied  by commercial  and
   residential  tenants.    In  accordance  with  established  policy,  the
   commercial tenants were notified of this application, but their comments
   were  not solicited.   Both  of  the residential  tenants have  provided
   written support for this application for strata title conversion.

   The site location is shown below in Figure 1.

   STAFF ANALYSIS

   In addition to Planning Department staff, the City Engineer and the City
   Building Inspector have reviewed this  application.  Given the nature of
   this application,  the Manager of the Housing  Centre has not been asked
   to comment.

   The CityEngineer has nodedication orservicing requirements forthis site.

   The City Building  Inspector reports that electrical upgrading work must
   be completed in order for the building to substantially comply with  all
   relevant by-laws.  An electrical permit will be required for this work.

   CONCLUSION

   Based  on the  foregoing, and  on  the applicant's  compliance with  the
   City's Strata Title and Cooperative Conversion Guidelines, the Associate
   Director of Planning - Land  Use and Development Division, supports this
   application.
