SUBJECT:	Revised Business License Hearing Panels for February 2000

RECOMMENDATION

A. THAT Council delegate the holding of four business license hearings, presently scheduled for February, 2000, to a panel of three Council Members, pursuant to Section 277.1 of the Vancouver Charter, as follows:

i. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by Ms. Dao Thi Mai, also known as Thi Dao Mai, doing business as Cozy Corner Grocery, 100 East Hastings Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:

Councillor Don Lee
Councillor Lynne Kennedy
Councillor Tim Louis

Should any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Fred Bass.

ii. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by Stadium Equities Ltd., doing business as West Hotel Pub, 488 Carrall Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:

Councillor Daniel Lee
Councillor Gordon Price
Councillor Sandy McCormick

Should any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Sam Sullivan.

iii. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by John Khosrow Hossiannia, doing business as Sahara Pawnbroker, 1132 Granville Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:

Councillor Sam Sullivan
Councillor Fred Bass
Councillor Gordon Price

Should any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Mayor Philip Owen.

iv. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by James Moozhayil, doing business as Star City Grocery, 356 Powell Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:

Councillor George Puil
Councillor Don Lee
Councillor Sandy McCormick

Should any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Tim Louis.

CITY MANAGER'S COMMENTS

The City Manager RECOMMENDS approval of the foregoing.

COUNCIL POLICY

Section 277.1 of the Vancouver Charter gives Council the power to delegate the holding of a business license hearing under section 275 or section 278, or an appeal under section 277, by Resolution, to one or more Council Members. On November 30, 1999, Council adopted a procedure relating to business license hearings whereby the hearings will generally be conducted before a panel of three Members of Council, although Council may designate that a hearing be conducted before a panel comprised of a greater number of Members of Council.

BACKGROUND

Four business license applications have been referred to Council by the Chief License Inspector pursuant to section 4(2a) of the License By-law, for hearings pursuant to section 275 of the Vancouver Charter in the month of February, 2000. Those applications are as follows:

(a) an application for a year 2000 business license from Ms. Dao Thi Mai, also known as Thi Dao Mai, doing business as Cozy Corner Grocery, 100 East Hastings Street, Vancouver, British Columbia;

(b) an application for a year 2000 business license from Stadium Equities Ltd., doing business as West Hotel Pub, 488 Carrall Street, Vancouver, British Columbia;

(c) an application for a year 2000 business license from John Khosrow Hossiannia, doing business as Sahara Pawnbroker, 1132 Granville Street, Vancouver, British Columbia; and

(d) an application for a year 2000 business license from James Moozhayil, doing business as Star City Grocery, 356 Powell Street, Vancouver, British Columbia.

The application by Ms. Dao Thi Mai, also known as Thi Doa Mai, doing business as Cozy Corner Grocery, is presently scheduled for hearing on February 3, 2000, from 7:30 p.m. to 10:30 p.m. The application by Stadium Equities Ltd., doing business as West Hotel Pub, is presently scheduled for hearing on February 14, 2000, from 9:30 a.m. to 3:30 p.m. The application by John Khosrow Hossiannia, doing business as Sahara Pawnbroker, is presently scheduled for hearing on February 15, 2000, from 9:30 a.m. to 12:30 p.m. The application by James Moozhayil, doing business as Star City Grocery, is presently scheduled for hearing on February 17, 2000, from 7:30 p.m. to 10:30 p.m.

The new amendment to the Vancouver Charter confers on Council the power to delegate the holding of business license hearings to one or more Members of Council. Council must designate, by Resolution, Members of Council who will deal with each specific hearing. The attached Resolutions will delegate the holding of each of the hearings in themonth of February to three named Members of Council.

CONCLUSION

Staff recommend that Council pass the Resolutions contained in this report.
