Business License Hearing Panels for January 2000

 

RECOMMENDATION

CITY MANAGER’S COMMENTS

COUNCIL POLICY

Section 277.1 of the Vancouver Charter gives Council the power to delegate the holding of a business license hearing under section 275 or section 278, or an appeal under section 277, by Resolution, to one or more Council Members. On November 30, 1999, Council adopted a procedure relating to business license hearings whereby the hearings will generally be conducted before a panel of three Members of Council, although Council may designate that a hearing be conducted before a panel comprised of a greater number of Members of Council.

BACKGROUND

Three business license applications have been referred to Council by the Chief License Inspector pursuant to section 4(2a) of the License By-law, for hearings pursuant to section 275 of the Vancouver Charter in the month of January, 2000. Those applications are as follows:

The application by 395392 BC Ltd., doing business as Stadium Inn Public House is presently scheduled for hearing on January 10, 2000, from 9:30 a.m. to 3:30 p.m. The application by James Sabation Moozhayit, doing business as Star City Grocery, is presently scheduled for hearing on January 18, 2000, from 9:30 a.m. to 12:30 p.m. The application by Nargis Malik, doing business as Rainbow Grocery, is presently scheduled for hearing on January 20, 2000, from 7:30 p.m. to 10:30 p.m.

The new amendment to the Vancouver Charter confers on Council the power to delegate the holding of business license hearings to one or more Members of Council. Council must designate, by Resolution, Members of Council who will deal with each specific hearing. The attached Resolutions will delegate the holding of each of the hearings in the month of January to three named Members of Council.

CONCLUSION

Staff recommend that Council pass the Resolutions attached to this report.

BE IT RESOLVED:

A. That the business license hearing of January 10, 2000, pursuant to Section 275 of the Vancouver Charter, regarding an application for a year 2000 business license from 395392 BC Ltd., dba the Stadium Inn Public House, 340 Cambie Street, Vancouver, British Columbia, be delegated to the following Members of Council:
· Councillor Daniel Lee
· Councillor George Puil
· Councillor Fred Bass
· Councillor Gordon Price (alternate)

B. That the business license hearing of January 18, 2000, pursuant to Section 275 of the Vancouver Charter, regarding an application for a year 2000 business license by James Sabation Moozhayit, doing business as Star City Grocery, 356 Powell Street, Vancouver, British Columbia, be delegated to the following Members of Council:
· Councillor Sam Sullivan
· Mayor Philip Owen
· Councillor Sandy McCormick
· Councillor Lynne Kennedy (alternate)

C. That the business license hearing of January 20, 2000, pursuant to Section 275 of the Vancouver Charter, regarding an application for a year 2000 business license by Nargis Malik, doing business as Rainbow Grocery, 120 West Hastings Street, Vancouver, British Columbia, be delegated to the following Members of Council:
· Councillor Gordon Price
· Councillor Jennifer Clarke
· Councillor Tim Louis
· Councillor Don Lee (alternate)
