GENERAL MANAGER’S COMMENTS

COUNCIL POLICY

There is no applicable Council policy except that Council did approve the original form of development for this site when the rezoning was approved, following a Public Hearing.

PURPOSE

In accordance with Charter requirements, this report seeks Council’s approval for the revised form of development for this portion of the above-noted CD-1 zoned site.

SITE DESCRIPTION AND BACKGROUND

At a Public Hearing on June 26, 1980, City Council approved a rezoning of various lands south of Southeast Marine Drive from M-1 Industrial, RT-2 Two-Family Dwelling and CD-1 Comprehensive Development Districts to M1-B Industrial and CD-1 Districts. CD-1 By-law Number 5381 governing the subject site was enacted on August 12, 1980.

Council approved text amendments to the CD-1 By-law at a Public Hearing on July 14, 1988. These amendments, enacted on August 1, 1989 under By-law Number 6537, were accompanied by Companion Guidelines (Fraser Lands Champlain Heights South Guidelines for CD-1 By-laws Numbered 5381 and 6537), and adopted by Council resolution on August 15, 1989.

On June 19, 1990, July 31, 1990, June 25, 1991, June 8, 1993 and July 6, 1993, further minor text amendments were incorporated by By-laws Numbered 6682, 6702, 6853, 7120 and 7139, respectively.

On July 31, 1990, Council approved by resolution that Companion Guidelines (Champlain Heights South CD-1 Guidelines [Sub-Area 1, Church Site] [By-law No. 5381]) be adopted for Sub-Area 1 only and that “Fraser Lands Champlain Heights South Guidelines” be amended to apply to Sub-Areas 2 - 5 only.

At a Public Hearing on May 28, 1998, Council approved text amendments to permit accessory uses to a Church. CD-1 By-law No. 7923 was enacted on July 21, 1998.

The site, surrounding zoning, and sub-area notations are shown on the attached Appendix ‘A’.

Subsequent to Council’s approval of the CD-1 rezoning, the Director of Planning approved Development Application Number DE403671. This approval was subject to various conditions, including Council’s approval of the form of development. The latter condition is one of the few outstanding prior to permit issuance.

DISCUSSION

This CD-1 site consists of a total of five sub-areas. On October 9, 1992, a development permit (DE214199) was approved for the construction of a two-storey Church building providing 73 off-street surface parking spaces on this site (Sub-Area 1).

The proposed development involves alterations and additions to this existing church with accessory uses, such as a gymnasium, chapel, Sunday school classrooms, and an underground parking facility and will be developed in two phases.

Phase 1 will involve a two-storey addition to the south side of the existing church. The ground floor addition (approximately 974.2 m²) will contain classrooms and chapel and the second floor addition (approximately 225.3 m²) will contain classrooms. Phase 1 will also involve the provision of additional parking spaces. This will be achieved with the addition of a two-level partially underground parking facility containing 134 parking spaces having vehicular access from Southeast Marine Drive. Alterations to the existing surface parking is also proposed and will decrease the surface parking from 73 to 26 spaces.

Phase 2 will involve a further two-storey addition to the south side of the existing church. The ground floor addition (approximately 494.2 m²) will contain a chapel gymnasium, additional classrooms and offices, and the second floor addition (approximately 408.0 m²) will contain classrooms and a multi-functional lounge.

The proposal has been assessed against the CD-1 By-law and the Council-approved guidelines and responds to the stated objectives.

Simplified plans, including a site and floor plans and elevations of the proposal, have been included in Appendix ‘B’.

CONCLUSION

The Director of Planning has approved Development Application Number DE403671, subject to various conditions to be met prior to the issuance of the development permit. One of these conditions is that the form of development first be approved by Council.
