Manufacturers License in Class D Neighbourhood PubRECOMMENDATION
THAT Council endorse the request by 472120B.C. Ltd., for a manufacturers license in the Class D Neighbourhood Pub at 871 Beatty Street, subject to the applicant signing a Good Neighbour Agreement prior to the issuance of the license.
GENERAL MANAGERS COMMENTS
The General Manager of Community Services RECOMMENDS approval of the foregoing.
COUNCIL POLICY
Council Policy requires that new liquor license applications and amendments to existing licenses be subject to a referendum if the premises are located in close proximity to residential accommodation.
PURPOSE
472120 B.C. Ltd., is requesting a Council resolution endorsing a change to the original endorsement of a Class D Neighbourhood Pub to provide an on-site manufacturers license (brewing facility) at 871 Beatty Street.
BACKGROUND
At its meeting on October 6, 1994, the Vancouver Liquor Licensing Commission passed the following motion:
THAT consideration of the request by 472120 B.C. Ltd. for a Class D Neighbourhood Pub Liquor License at 871 Beatty Street, be subject to the results of a referendum conducted in accordance with existing City Council guidelines;
AND FURTHER THAT, if approved, the development not include a patio nor off-premise sales.
A referendum was conducted, and on July 25, 1996, the Vancouver Liquor Licensing Commission resolved:
THAT the Vancouver Liquor Licensing Commission advise the General Manager, Liquor Control and Licensing Branch, it supports the application by 472120 B.C. Ltd. for a Class D Neighbourhood Pub liquor license for the premises located at 871 Beatty Street, having considered:
a) the support of the residents and business operators of the community, as expressed through the results of a neigbourhood referendum;
b) the proximity of the establishment to other social facilities and public buildings;
c) traffic, road access and availability of parking;
d) noise and appearance of the proposed establishment;
FURTHER THAT the endorsement of this application be subject to the conditions this development not include an outdoor patio nor off-premise liquor sales and the existing Class C Cabaret license for this site be cancelled.
The cabaret ceased operation in 1996. Development permit DE401419 issued on December 11, 1996, includes the addition of a fourth storey and change of use of the existing three-storey plus basement building from existing cabaret to provide a neighbourhood pub/restaurant.
The renovation of this building is nearing completion, but the applicants plans over the past year have evolved to now include on-site brewing. The Liquor Control and Licensing Branch define a brew pub as the combination of a pub with a small brewery making beer on a limited production basis. Sale of the beer is restricted to on-premise consumption although if the licensee has an off-sale endorsement for his pub or a Licensee Retail Store (Beer and Wine Store) the product may be packaged in approved sizes and sold in this manner. A manufacturers license is required for this type of facility.
The Liquor Control and Licensing Branch recently amended its application process for a manufacturers license (brewing facility) to include the requirement of a local government resolution.
DISCUSSION
The Class DNeighbourhood Pub at 871 Beatty Street has completed the City of Vancouver liquor license process including a public notification, referendum and endorsement by Council.
The addition of on-site brewing facilities without off-sales will have no additional impacts on the surrounding community. Therefore, further notification of the surrounding community is not deemed necessary.
CONCLUSION
Staff recommends that the request for a brewing facility in this Class D Neighbourhood Pub be endorsed and that the applicant sign a Good Neighbour Agreement prior to the issuance of the license.
