RECOMMENDATION

GENERAL MANAGER’S COMMENTS

COUNCIL POLICY

Council Policy requires that new liquor license applications and amendments to existing licenses be subject to a referendum if the premises are located in close proximity to residential accommodation.

PURPOSE

472120 B.C. Ltd., is requesting a Council resolution endorsing a change to the original endorsement of a Class ‘D’ Neighbourhood Pub to provide an on-site manufacturer’s license (brewing facility) at 871 Beatty Street.

BACKGROUND

At its meeting on October 6, 1994, the Vancouver Liquor Licensing Commission passed the following motion:

A referendum was conducted, and on July 25, 1996, the Vancouver Liquor Licensing Commission resolved:

The cabaret ceased operation in 1996. Development permit DE401419 issued on December 11, 1996, includes the addition of a fourth storey and change of use of the existing three-storey plus basement building from existing cabaret to provide a neighbourhood pub/restaurant.

The renovation of this building is nearing completion, but the applicant’s plans over the past year have evolved to now include on-site brewing. The Liquor Control and Licensing Branch define a brew pub as the combination of a pub with a small brewery making beer on a limited production basis. Sale of the beer is restricted to on-premise consumption although if the licensee has an off-sale endorsement for his pub or a Licensee Retail Store (Beer and Wine Store) the product may be packaged in approved sizes and sold in this manner. A manufacturer’s license is required for this type of facility.

The Liquor Control and Licensing Branch recently amended its application process for a manufacturer’s license (brewing facility) to include the requirement of a local government resolution.

DISCUSSION

The Class ‘D’Neighbourhood Pub at 871 Beatty Street has completed the City of Vancouver liquor license process including a public notification, referendum and endorsement by Council.

The addition of on-site brewing facilities without off-sales will have no additional impacts on the surrounding community. Therefore, further notification of the surrounding community is not deemed necessary.

CONCLUSION

Staff recommends that the request for a brewing facility in this Class ‘D’ Neighbourhood Pub be endorsed and that the applicant sign a Good Neighbour Agreement prior to the issuance of the license.
