752 East Broadway - Hooters Rock Shop
Business License No. 98-176159 RDRECOMMENDATION
THAT Vancouver City Council conduct a hearing to determine whether or not the 1998 Business License issued to John Beverly doing business as Hooters Rock Shop, 752 East Broadway, should be suspended or revoked due to criminal activity occurring at the business premises;
AND THAT Vancouver City Council conduct a hearing to determine whether or not future Business License applications by John Beverly should be referred to Vancouver City Council.
GENERAL MANAGERS COMMENTS
The General Manager of Community Services RECOMMENDS approval of the foregoing.
COUNCIL POLICY
Section 278 of the Vancouver Charter states:
The Chief License Inspector may, in any case, recommend to Council in writing the suspension or revocation of any license, setting out the reasons for such recommendation. The Council shall not suspend or revoke the license without previous notice and an opportunity to be heard being given to the holder thereof, except when by reasonable efforts the holder cannot be found.
PURPOSE
The Chief License Inspector hereby requests that City Council hold a hearing to determine whether or not to revoke or suspend the Business License of John Beverly doing business as Hooters Rock Shop at 752 East Broadway.
BACKGROUND
In September of 1998, the Chief License Inspector reviewed Police evidence relating to criminal activities at 752 East Broadway, including drug trafficking, possession of weapons and possession of narcotics, and met with John Beverly (licensee) to discuss the management of this retail store. Due to the serious nature of the evidence, I decided to recommend to City Council that this Business License be suspended or revoked pursuant to Section 278 of the Vancouver Charter. A Hearing date will be scheduled as early as possible and the license holder will be notified.
At a Special Meeting of City Council, Counsel for the City of Vancouver will present the evidence and the licensee will be given an opportunity to address City Council.
