780 Main Street - Proposed Closure of a Portion of the Lane, East of Main Street, North from Union Street
RECOMMENDATION
THAT Council close, stop-up and convey, to the abutting owner, that portion of the lane east of Main Street, north from Union Street, shown hatched on the plan attached as Appendix "A", subject to the following conditions:
1) The portion of lane to be closed to be consolidated with the abutting Lot 9, except the east 10 feet, now lane, Block 20, District Lot 196, Plan 184, to the satisfaction of the Director of Legal Services.
2) The abutting owner to pay $28,750, plus G.S.T., if applicable, as the value for the 250 square foot portion of lane to be closed in accordance with the recommendation of the Manager of Real Estate Services.
3) The abutting owner to be responsible for any necessary plans and documents.
4) Any agreements are to be to the satisfaction of the Director of Legal Services.
5) No legal right or obligation shall be created and none shall arise hereafter until the documents are executed.
If Council approves this report, the Formal Resolution to close this lane will be before Council later this day for approval.
COUNCIL POLICY
The authority for closing and disposing of street and lanes is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to obtain Council approval to close, stop-up and convey to the abutting owner, a portion of the lane, east of Main Street, north from Union Street.
DISCUSSION
An application has been received to purchase the 10 feet of lane shown hatched on the plan hereto, attached as Appendix "A", and abutting Lot 9, except the east 10 feet, now lane, Block 20, District Lot 196, Plan 184 (780 Main Street). The present width of the lane is 30 feet at this location and our requirement for this lane is only 20 feet. Therefore, the residual strip, 10 feet in width, on the east side of the Remainder of Lot 9, 250 square feet (23.2 square metres), is no longer required for lane purposes and could be closed, stopped-up and sold to the abutting owner.
The owner of the Remainder of Lot 9 (780 Main Street) has agreed to pay $28,750, plus G.S.T., if applicable, for the 250 square feet of lane to be closed. The City owns in title, the East 10 feet of Lot 9, Block 20, District Lot 196, Plan 184. The East 10 feet of Lot 9 was established as lane, by document filed 33756, in 1941. The portion of lane to be closed will be consolidated with the abutting Lot 9 to form a single parcel, to the satisfaction of the Director of Legal Services. We note that the owner also owns Lot 8, the property immediately north of the subject site. The owner may include Lot 8 within the consolidation plan. We have no objections to this. The abutting owner is to be responsible for all plans and documents.
In the opinion of the Manager of Real Estate Services, the sale price is fair and reasonable.
