Dear Mayor Johnson and Members of Council:

Vancouver Landfill - Agreement with Delta

At its (In Camera) meeting on March 10, 1998, Vancouver City Council passed the following motions:

"A.THAT the Mayor, on behalf of Council, write to the Mayor and Council of Delta and advise them of the following:

(i)Vancouver as a condition of its approval to the Landfill Agreement attaches the "Interpretation" (Appendix A) on the amendments to the Landfill Agreement adopted by Delta Council on November 25, 1997.

(ii)If Delta agrees with this "Interpretation", then Vancouver is prepared to enter into an agreement incorporating the following:

-agreement as approved by Vancouver Council on October 28, 1997;

-amendment to the agreement as approved by Delta Council on November 25, 1997;

-the attached "Interpretation" approved by both Councils.

B. THAT the Director of Legal Services and Director of Engineering Services be authorized to negotiate final language and sign a Landfill OperatingAgreement as outlined in the above recommendation (i)."

"THAT, during the six-month planning program, the City of Vancouver withhold payment of new royalty, retroactive royalties, and continued acceptance of Delta residential waste at no charge; and upon completion and delivery of an end-use plan endorsed by both Councils, Vancouver will reinstate all benefits included in the proposed agreement, retroactive to the date of expiry of the old agreement."
