   SUBJECT:  5880 Kerr Street - Proposed Closure of a Portion of the
             East Side of Kerr Street, North of 45th Avenue


   RECOMMENDATION

        THAT Council close, stop-up and convey to the abutting owner, that
        portion of the east side of Kerr Street, north of 45th Avenue,
        shown hatched on the plan attached as Appendix "A", subject to the
        following conditions:

             1.   The abutting owner to pay $28,037 plus G.S.T., if
                  applicable, as the value for the approximately 18.7 foot
                  wide (615 square feet) portion of Kerr Street to be
                  closed, in accordance with the recommendation of the
                  Manager of Real Estate Services.

             2.   The portion of Kerr Street to be closed is to be
                  consolidated with the abutting lands, to form a single
                  parcel, the same as shown within the heavy outline on the
                  plan attached as Appendix "A".

             3.   The abutting owner to be responsible for any necessary
                  plans and documents.

             4.   Any agreements are to be to the satisfaction of the
                  Director of Legal Services.

             5.   No legal right or obligation shall be created hereby and
                  none shall arise hereafter until the documents are
                  executed.

   COUNCIL POLICY

   The authority for closing and disposing of streets and lanes is set out
   in the Vancouver Charter.


   PURPOSE

   The purpose of this report is to seek Council approval to close, stop-up
   and convey to the abutting owner a portion of the east side of Kerr
   Street, north of 45th Avenue, that is no longer required for road
   purposes.


   DISCUSSION

   An application has been received to purchase an approximate 18.7 foot
   wide strip of road abutting Lot 8, except the West 33 feet, North West
   1/4 of Block 17, District Lot 50, Plan 3316.  The present width of Kerr
   Street adjacent to this property, is approximately 84.7 feet and our
   requirement for Kerr is 66 feet in width.  Therefore, the residual
   strip, approximately 18.7 feet wide, is no longer required for road
   purposes and could be closed, stopped-up and sold to the abutting owner.

   CONCLUSION

   The present width of Kerr Street, north of 45th Avenue, is approximately
   18.7 feet greater than required to meet our future road requirements. 
   We recommend that the 18.7 feet that is in excess of our requirements,
   be closed, stopped-up and sold to the abutting owner, subject to the
   conditions set out in this report.
