   SUBJECT:  Strata Title Conversion: 1561-1563 East 10th Avenue


   RECOMMENDATION

        THAT the application to convert the previously-occupied building at
        1561-1563 East 10th Avenue (Lot A of 28 and 29, Block 161, D.L.
        264A, Plans 222 and 1771) to strata title ownership be approved.

   GENERAL MANAGER'S COMMENTS

        The General Manager of Community Services RECOMMENDS approval of
        the foregoing.

   COUNCIL POLICY

   Council policy is reflected in the City's Strata Title and Cooperative
   Conversion Guidelines, which outline factors which Council will consider
   in reviewing applications for converting previously-occupied buildings
   to strata title or cooperative ownership.

   PURPOSE

   Council approval is required for an application to convert the
   previously-occupied building at 1561-1563 East 10th Avenue (Lot A of 28
   and 29, Block 161, D.L. 264A, Plans 222 and 1771) to strata title
   ownership.

   BACKGROUND

   The site is zoned RT-5 and is developed with a new two-family dwelling
   which was constructed in 1996, under Development and Building Permit No.
   DB400652.  The owner proposes to create two strata lots.

   Both dwelling units are currently occupied, one by the property owners
   and one by their family members.  There are no rental tenants involved
   in this project.  The owners have always intended to strata title their
   building, but did not realize that following occupancy, City approval
   for the "conversion" would be required.

   The site location is shown below in Figure 1.

   STAFF ANALYSIS

   In addition to Planning Department staff, the City Engineer and the City
   Building Inspector have reviewed this application.  As this conversion
   only involves an owner-occupied, two-unit dwelling, the Manager of the
   Housing Centre has not been asked to comment.

   The City Engineer has no dedication or servicing requirements for this
   site.

   The City Building Inspector reports that all work related to the permits
   issued in 1996 has been completed and that this building currently
   substantially complies with all relevant City by-laws.

   CONCLUSION

   Based on the foregoing, and on the applicant's compliance with the
   City's Strata Title and Cooperative Conversion Guidelines, the Director
   of Land Use and Development supports this application.
