   SUBJECT:  Local Improvement Reballots


   RECOMMENDATION

        A.   THAT the original petition for pavement and curbs and trees on
             Skeena Street from 26th Avenue to 27th Avenue, Court #577,
             Item #037, not be approved. 

        B.   THAT the original petition for lane pavement on the lane north
             of 27th Avenue from Camosun Street to Crown Street, Court
             #577, Item #060, not be approved.

        C.   THAT the original petition for speed humps on the lane north
             of 27th Avenue from Camosun Street to Crown Street, Court
             #577, Item #071, not be approved.


   COUNCIL POLICY

   Policies governing the Local Improvement Process are set out in the
   Vancouver Charter and the Local Improvement Procedure By-Law.  The
   projects dealt with in this report have gone through the legal
   requirements in the process, but Council has requested additional
   information on project support/opposition through reballots before
   giving final approval.


   PURPOSE

   At the March 27, 1997 Court of Revision, Council has instructed staff 
   to reballot these local improvement petition projects.

   This has been done and the results are as follows:

   Court #577, Item #037, Pavement and Curbs and Trees on Skeena Street
   from 26th Avenue to 27th Avenue (Petition)

   Number of owners         16
   Required 2/3 majority    11

   Ballot results:     In Favour       9
                       Opposed         5
                       Responses      14

   The two owners who did not return their ballots, were sent a second
   ballot and still did not respond. One of these owners had signed the
   original petition. If this owner is assumed to be in favour, there is
   insufficient support for this project to proceed.


   Court #577, Item #060, Lane paving on the lane north of 27th Avenue from
   Camosun Street to Crown Street
   (Petition)

   Number of owners         13
   Required 2/3 majority     9

   Ballot results:     In Favour    2
                       Opposed      7
                       Responses    9

   Based on the ballot results, a two thirds majority is not possible as
   more than one-third of the owners are now opposed to the project. 
   Therefore, it is recommended that this project not proceed.
