Capones Pizza Bar Co. Limited - Restaurant-Class 2
CONSIDERATION
A. THAT consideration of the request by Capones Pizza Bar Co.
Limited, for a Restaurant-Class 2 at Capones, 1141 Hamilton
Street, be subject to a referendum, conducted in accordance
with existing City guidelines;
or
B. THAT the Vancouver Liquor Licensing Commission endorse the
request by Capones Pizza Bar Co. Limited, for a
Restaurant-Class 2 at Capones, 1141 Hamilton Street, having
considered the support of residents and business operators of
the community as determined by neighbourhood notification;
or
C. THAT the Vancouver Liquor Licensing Commission advise the
Liquor Control and Licensing Branch it does not endorse the
application by Capones Pizza Bar Co. Limited, for a
Restaurant-Class 2 at Capones, 1141 Hamilton Street, having
considered community opinion as determined by neighbourhood
notification.
GENERAL MANAGER'S COMMENTS
The General Manager of Community Services submits the choice of A,
B or C for CONSIDERATION.
COUNCIL POLICY
Council policy requires that new liquor license applications be subject
to a referendum prior to receiving final consideration if the premises
are located in close proximity to residential accommodation.
PURPOSE
Capones Pizza Bar Co. Limited, is requesting a City Council resolution
endorsing its application for a Restaurant-Class 2 at Capones, 1141
Hamilton Street.
BACKGROUND
Capones is to be located in a 100-year old warehouse building. The
seating capacity is 50 plus 12 additional seats located on the loading
dock patio, the hours of operation for the restaurant will be 11:00 a.m.
to 1:00 a.m. seven days a week. The restaurant will feature live jazz
music performed by a maximum of four local or international musicians
until 12:00 midnight Monday to Saturday.
The subject premises are located in the HA-3 (Yaletown Historic) and
HA-4 (Yaletown Dock) zoning district (Appendix A). The surrounding area
is a mixture of warehouse, office, retail and residential. The closest
residential premises are located across the street at 1150 Hamilton and
new residential construction at the end of the block at 1201 Hamilton.
Also within the survey area are the Roundhouse, a seniors centre, an
intermediate care facility, a community centre and one park. The
closest government liquor store is located at 1155 Bute Street.
There is one Class 'A' Pub (225 seats), one Class 'A' Lounge (92
seats), six Class 'C' Cabarets (1,631 seats), and approximately 23
licensed restaurants in the survey area.
COMMENTS
The Police Department has no objections.
The Environmental Health Division of the Vancouver Health Board does not
oppose the application on the condition that restricted hours of
operation may be required, should noise complaints arise.
The Planning Department advises this portion of the site is approved as
a Restaurant-Class 1 in conjunction with a billiard hall on the upper
storey. Any proposal to provide a Restaurant-Class 2 would require a
Development Permit application.
Restaurant-Class 2 is a "conditional" use in these zoning districts, and
would require special consideration by the Director of Planning. The
review process for an application of this type would include an
assessment of compatibility with surrounding uses and the impact of such
a use on neighbouring sites.
The Social Planning Department has no objections, subject to the
entertainment ending at 12:00 midnight.
The Housing Centre has no comments.
CONCLUSION
This proposal for a Restaurant-Class 2 includes a small jazz band to be
located at the rear of the premises, a storey below Homer Street. With
this design, the noise impacts on Hamilton Street are expected to be
minimal.
