THAT the original local improvement project for lane pavement on the lane south of 3rd Avenue from Trafalgar Street to Larch Street except VR 1063, Court #571, Item #035, be approved. B. THAT the original petition for lane lighting on the lane south of Georgia Street from Hawks Avenue to Campbell Avenue, Court #574, Item #003, be approved. C. THAT the original petition for pavement and curbs and trees on 26th Avenue North Side from Rupert Street to Cassiar Street and 26th Avenue South Side from Rupert Street to the east property line of Lot 20 (3394 E 26th Avenue), Court #574, Item #050, be approved. D. THAT the original petition for lane pavement on the lane south of 17th Avenue from Macdonald Street to Trafalgar Street, Court #574, Item #064, be approved. COUNCIL POLICY Policies governing the Local Improvement Process are set out in the Vancouver Charter and the Local Improvement Procedure By-Law. The projects dealt with in this report have gone through the legal requirements in the process, but Council has requested additional information on project support/opposition through reballots before giving final approval. PURPOSE At the November 16, 1995 and June 11, 1996 Courts of Revision, Council instructed staff to reballot these local improvement petition projects and one initiative project. This has been done and the results are as follows: -2- Court #571, Item #035, Lane Pavement on the lane south of 3rd Avenue from Trafalgar Street to Larch Street except VR 1063 (Initiative) Number of owners 83 Required to Defeat 42 Ballot results: In Favour 38 Opposed 34 72 This higher-zoned lane was initiated to address Council s stated priority on infrastructure renewal. These lanes tend not to be improved by petition due to absentee ownership, yet they carry much more traffic than residential lanes, and the lane surface deteriorates as a result. This causes high maintenance cost and a significant number of complaints from commercial and/or apartment tenants. This project was delayed due to a property being stratified into 73-units. The management company asked that we wait six months until most of the units were sold. The ballot results indicate that the majority of property owners are in favour of the project. Therefore, we recommend that this project proceed. Based on the ballot results, there is sufficient support for this project to proceed. Court #574, Item #050, Pavement and Curbs and Trees on 26th Avenue North Side from Rupert Street to Cassiar Street and 26th Avenue South Side from Rupert Street to the east property line of Lot 20 (3394 E 26th Avenue) (Petition) -3- Number of Owners 28 Required 2/3 majority 19 Ballot Results: In Favour 17 Opposed 7 24 Of the four owners who did not return their ballots, none could be contacted by phone. Of these four owners, three had signed the original petition. If these owners are assumed to be in favour, there is sufficient support for the project to proceed.
