Proposed Road Closures
RECOMMENDATIONS
A. THAT all those portions of Rupert Street, from Hastings Street
to Pender Street; Hastings Street east of Rupert Street; the
lane east of Rupert Street from Hastings Street to Pender
Street; and the lane south of Hastings Street east from the
lane east of Rupert Street, each the same as shown hatched on
the plan attached as Appendix "A", be closed, stopped-up and
re-subdivided subject to the following conditions:
(i) the said City streets and lanes to be closed are to be
subdivided to create a single parcel, as shown within
the heavy outline on the plan attached as Appendix "B",
dedicating the portions required for Hastings Street
(approximately as shown shaded on Appendix "B") to the
satisfaction of the General Manager of Engineering
Services and the Approving Officer; and
(ii) relocation or removal of existing utilities within the
lanes to be closed to the satisfaction of the General
Manager of Engineering Services; and
(iii) provision of a Statutory Right-of-Way for utilities and
access over a portion of the said portion of Rupert
Street to be closed, the same as shown approximately on
the plan attached as Appendix "C", to the satisfaction
of the General Manager of Engineering Services and the
Director of Legal Services; and

(iv) provision of a Statutory Right-of-Way for utilities and
access over a portion of Lot 28 of Lot 60, Town of
Hastings Suburban Lands, Plan 330, the same as shown
approximately on Appendix "C", to the satisfaction of
the General Manager of Engineering Services and the
Director of Legal Services; and
(v) the Emergency Operations and Communications Centre
(E.O.C.C.) to be responsible for all costs to remove or
relocate utilities as necessary, and any costs
associated with physically closing the streets and
lanes to the satisfaction of the General Manager of
Engineering Services; and
(vi) completion of acquisition of privately owned Lots 28
and 29 of Lot 60, Town of Hastings Suburban Lands, Plan
330, by the Manager of Real Estate Services; and
B. THAT the Director of Legal Services be authorized to execute
any plan, transfers and documents required to complete
Recommendation A, on behalf of the City.
COUNCIL POLICY
The authority for closing and disposing of portions of streets and lanes
is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to seek Council authority to close and
stop-up portions of streets and lanes as required to allow for the
construction of the E.O.C.C. at the southeast corner of Rupert Street
and Hastings Street (3350 East Hastings Street).
BACKGROUND
On February 29, 1996, the Standing Committee on Planning and Environment
approved a series of Recommendations contained in a report from the
Manager of Facilities Development and the Manager of Real Estate
Services pertaining to the proposed rezoning and development, of an
E.O.C.C. at the southeast corner of Rupert Street and Hastings Street.
On April 2, 1996, Council passed a number of Recommendations as
contained in a report from the General Manager of Engineering Services
dealing with and describing a land exchange between the City of
Vancouver and the M.O.T.H. along the portion of the Trans-Canada Highway
known as the Cassiar Connector. The subject site lies immediately west
of the Cassiar Connector. On June 27, 1996, Council approved, subject
to a number of conditions, the rezoning of the subject site.

DISCUSSION
The proposed E.O.C.C. site and abutting lands are presently made up of
the following titled properties, which as a condition of rezoning, must
be subdivided to form a single site as shown on Appendix "B".
1. City-owned lands, Lots 1 and 9 to 15, each except the portions
in Plan 4299 and Highway Plan 46 and Lots 2 to 8 and 30 to 32,
all of Lot 60, Town of Hastings Suburban Lands (T.H.S.L.),
Plan 330; and
2. privately owned lands, Lots 8 and 29 of Lot 60, T.H.S.L., Plan
330; and
In addition, the site contains or is abutted by, the following
dedicated or established streets and lanes; each of which must be
closed, stopped-up and re-subdivided with the abutting lands,
re-dedicating road as necessary to allow for the formation of the
subject parcel shown on Appendix "B".
1. Portions of Rupert Street between Hastings Street and Pender
Street dedicated by the deposit of Plan 100. (Plan 100
represents a re-survey of the original Hastings Townsite and
covers all those portions of the City of Vancouver that lie
north of 29th Avenue and East of Nanaimo Street. The portion
of Rupert Street is 99 feet wide and contains an 8 inch water
main and underground electrical services. The General Manager
of Engineering Services supports the closure and subdivision
of the subject portion of Rupert Street to allow for its
inclusion within the E.O.C.C. project, subject to registration
of a right-of-way to contain the existing utilities, future
sewer lines and water mains, and the provision of an access
route connecting Hastings Street and Pender Street. These
provisions are addressed by condition (iii) to Recommendation
A, and reflect Condition B (vii) of the Rezoning Report).
2. Portion of Hastings Street east of Rupert Street. (The north
20 feet of the portion of Hastings Street shown hatched on
Appendix "A" has existing titles, being "those portions of
Lots 1 and 9 to 15, in Plan 4299 of Lot 60, T.H.S.L., Plan
330", each in the name of the City of Vancouver and each
"established as road" by documents B78131L, B78132L and
B78133L, filed in the Land Title Office in 1974. The portion
of Hastings Street shown hatched on Appendix "A" that lies
southerly of Plan 4299 was intended to be dedicated road by
Highway Plan 46, prepared in August 1961. The documents
required to dedicate these portions as road were not dealt
with by

the Land Title Office until April 1996. "Those portions of
Lots 1 and 9 to 15 on Highway Plan 46", now dedicated road,
represents one of the numerous clean-up items described in the
above-mentioned report on the Cassiar Connector on April 2,
1996. Including those portions of Hastings Street within the
area of the proposed closure and re-subdivision acts to
simplify both City and Land Title Office records, and is
consistent with the intent of the Cassiar Connector Report.
In addition, Appendix "B" shows the dedication of a
significant portion of the subject site for a widening of
Hastings Street. This widening was built with the Cassiar
Connector and is presently in use, meaning traffic is driving
over titled land as opposed to dedicated road. The southerly
limit of the dedication is as agreed to between the City and
M.O.T.H. Completing this dedication now removes one of the
items to be completed in the Cassiar Connector Exchange).
3. All the lane east of Rupert Street from Hastings Street to
Pender Street dedicated by the deposit of Plan 330. (Plan 330
was deposited in October 1889. This portion of lane contains
a 15 inch sewer line and overhead utilities that will have to
be removed or relocated. Condition (ii) to Recommendation A
addresses this requirement).
4. All the lane south of Hastings Street from the lane east of
Rupert Street to the northerly portion of the easterly limit
of Lot 28 dedicated by the deposit of Plan 330. (This portion
of lane contains a 12 inch sewer line and overhead utilities
that will have to be removed or relocated. (Condition (ii) to
Recommendation A). In addition, we have indicated that Lots
28 and 29 are privately owned. The closure of the lane on the
northerly edge of these properties cannot be completed without
the acquisition of these lands for their inclusion in the
development. Lots 27 to 29 are presently served by a lane
running north/south on M.O.T.H.-owned Lot 26 and City-owned
Lot 30, plus the dedicated lane to their north. As Lot 27
will not be acquired at this time, it is necessary to provide
a right-of-way to ensure utility and vehicle access to Lot 27.
This is reflected by condition (v) to Recommendation A.)
A number of existing utilities must be relocated, with all
costs the responsibility of the E.O.C.C.

It is noted that portions of Lots 13 to 14 proposed to be dedicated
(Appendix "B") as a requirement of this report, may eventually be the
subject of a request to Council to close portions of them and include
them as an air-space parcel for the Hastings Street Tunnel to the
Cassiar Connector. However, the E.O.C.C. Project and the Cassiar
Connector must each be able to proceed on their own merits. As such,
the dedications as shown on Appendix "B" are required to ensure the
City's needs for Hastings Street are met.
CONCLUSION
The closures sought in this report are required to complete the land
assembly for the E.O.C.C.
The General Manager of Engineering Services in consultation with the
Manager of Real Estate and the Director of Legal Services support
approval of Recommendations and B.
