File No.000 394 TO: Vancouver City Council FROM: General Manager of Engineering Services SUBJECT: Proposed Closure of Portion of the West Side of Nanaimo Street South of 34th Avenue RECOMMENDATION THAT all that portion of Nanaimo Street shown within the bold outline on the plan attached as Appendix "A", (the westerly 17.54 feet), be closed, stopped-up and conveyed to the abutting owner subject to the following conditions: 1. The purchase price to be $58,000 plus applicable taxes, for the 1158 square feet of closed road, in accordance with the recommendation of the Manager of Real Estate Services. The purchase price to be credited to Account Number 61/05/7011/999 - Unappropriated Left-Turn Bay Property Fund. 2. The closed road is to be subdivided with the abutting westerly parcels to the satisfaction of the Director of Legal Services and the Approving Officer. 3. The abutting owner to be responsible for any necessary plans, documents and Land Title Office fees. 4. Any agreements are to be to the satisfaction of the Director of Legal Services. 5. No legal right or obligation shall be created and none shall arise hereafter, until the documents are executed. If Council approves this report, the Formal Resolution to close this portion of Nanaimo Street will be before Council later this day for approval. COUNCIL POLICY The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter. PURPOSE The purpose of this report is to seek Council authority to close and stop-up, and sell a portion of the west side of Nanaimo Street south of 34th Avenue. BACKGROUND Nanaimo Street was identified in the Bartholomew Plan as a major street. It was proposed as a "Pleasure Drive" and recommended to become 120 feet in width through to Marine Drive. The redevelopment of Fraserview did not include the Nanaimo Street connection to Marine Drive and consequently, the role of Nanaimo Street south of 41st Avenue has been limited to a local collector street. DISCUSSION The subject closure lies in the section of Nanaimo Street between Kingsway and 41st Avenue. Although final design work on this portion of Nanaimo Street has not been done, it is clear that a 120 foot wide road is more than will be required at this location. A 75.46 foot (23 metre) corridor would be sufficient to provide for our future road improvements. Nanaimo Street is presently 93 feet (28.346 metres) in width, immediately south of 34th Avenue, therefore 17.54 feet (5.346 metres) could be closed and sold to the abutting owner. A prospective purchaser of the abutting Lot A (see R 57596) of Lot 1, Block 2, District Lot 394, Plan 2050 (2294 East 34th Avenue) has applied to purchase the portion of road which is no longer needed. Council, on June 25, 1996, approved a similar closure on the west side of Nanaimo Street, south of 35th Avenue. CONCLUSION The present width of Nanaimo Street to the south of 34th Avenue is 93 feet (28.346 metres), while only 75.46 feet (23 metres) is required to meet our future road requirements. We recommend that the 17.54 feet (5.346 metres) that is in excess of our requirement, be closed, stopped-up, and sold to the abutting owner subject to the conditions set out in this report. * * * * * General Mgr./Dept.
