File No. GL TO: Vancouver City Council FROM: Director of Land Use and Development SUBJECT: Strata Title Conversion: 2025 and 2027 East Kent Avenue North RECOMMENDATION THAT the application to convert the previously-occupied buildings at 2025 and 2027 East Kent Avenue North (Lot E, Block O, D.L. 328, Plan 8555) to strata title ownership be approved in principle, but that pursuant to Section 9(1) of the Condominium Act, the Certificate of Approval (Form 10) shall not be issued unless the following condition has been met within one year of the date of this approval: Completion of all work required by the City Building Inspector, under the required permits, at no cost to the City, in order that the previously-occupied principal and infill buildings on this site substantially comply with all relevant by-laws. GENERAL MANAGER'S COMMENTS The General Manager of Community Services RECOMMENDS approval of the foregoing. COUNCIL POLICY Council Policy is reflected in the City's Strata Title and Cooperative Conversion Guidelines, which outline factors which Council will consider in reviewing applications for converting previously-occupied buildings to strata title or cooperative ownership. PURPOSE Council approval is required for an application to convert the previously-occupied buildings at 2025 and 2027 East Kent Avenue North (Lot E, Block O, D.L. 328, Plan 8555) to strata title ownership. BACKGROUND The site is zoned RS-1B and is developed with a principal one-family dwelling built circa 1957, and an infill one-family dwelling, completed in 1987 under Development Permit No. DP203343 and Building Permit Nos. BP205377 and BP806950. The principal dwelling is owner-occupied. The infill dwelling is presently vacant, but was occupied by tenants until March 4, 1996. As stated in the applicant's notarized declaration submitted with their application, the tenants vacated the dwelling following notice of termination due to rental arrears. The owner proposes to create two strata lots in total; the principal building as one, and the infill dwelling comprising the other strata lot. The site is shown below in Figure 1. Figure 1 STAFF ANALYSIS In addition to Planning Department staff, the City Engineer and the City Building Inspector have reviewed this application. Given the nature of this application, the Manager of the Housing Centre has not been asked to comment. The City Engineer has no dedication or servicing requirements for this site. The City Building Inspector reports that the principal building must be fully sprinklered, and that the existing sprinkler system in the infill building must be upgraded, under the necessary permits, in combination with other building, plumbing and electrical upgrading to each building, in order to bring these buildings into substantial compliance with all relevant by-laws. CONCLUSION Based on the foregoing, and on the applicant's compliance with the City's Strata Title and Cooperative Conversion Guidelines, the Director of Land Use and Development supports this application. * * *
