SUBJECT: Strata Title Conversion: 60 West 12th Avenue
RECOMMENDATION
THAT the application to convert the previously-occupied building at
60 West 12th Avenue (Lot 3, Block 44, D.L. 302, Plan 198) to strata
title ownership be approved.
GENERAL MANAGER'S COMMENTS
The General Manager of Community Services RECOMMENDS approval of
the foregoing.
COUNCIL POLICY
Council policy is reflected in the City's Strata Title and Cooperative
Conversion Guidelines, which outline factors which Council will consider
in reviewing applications for converting previously-occupied buildings
to strata title or cooperative ownership.
PURPOSE
Council approval is required for an application to convert the
previously-occupied building at 60 West 12th Avenue (Lot 3, Block 44,
D.L. 302, Plan 198) to strata title ownership.
BACKGROUND
The site is zoned RT-6 and is developed with a three-storey, multiple
conversion dwelling containing three residential units. The building
was recently altered under Development Permit No. DE308603 and Building
Permit No. BU220539, and an Occupancy Permit (OP401193) was issued
October 10, 1995.
The current owner took vacant possession of this property in June, 1994.
Since then the property has remained vacant while undergoing
alterations. Although there is no record to indicate exactly when the
building may have been last occupied by tenants, the applicant has
indicated it was vacated in May, 1994. Prior to renovation, the
building's approved occupancy was one dwelling unit on the first storey
and two housekeeping units on each of the second and third storeys.
There is no evidence of when or how previous tenants may have been given
notice of termination by the previous owner. Further, there is no
evidence to suggest that the previous tenants were treated unfairly.
The site location is shown below in Figure 1.

STAFF ANALYSIS
In addition to Planning Department staff, the City Engineer and the City
Building Inspector have reviewed this application. As there are only
three residential dwelling units on this site, the Manager of the
Housing Centre has not been asked to comment.
The City Engineer has no dedication or servicing requirements for this
site.
The City Building Inspector reports that the building substantially
complies with all relevant City by-laws.
CONCLUSION
Based on the foregoing, and on the applicant's compliance with the
City's Strata Title and Cooperative Conversion Guidelines, the Director
of Land Use and Development supports this application.
