SUBJECT: Local Improvement Reballots
RECOMMENDATION
A. THAT the original petition for lane lighting on the lane south
of 36th Avenue from the lane east of Blenheim Street to
Balaclava Street, Court #568, Item #028, not be approved.
B. THAT the original petition for pavement and curbs and trees on
34th Avenue from Carnarvon Street to Mackenzie Street, Court
#568, Item #043, be approved.
COUNCIL POLICY
Policies governing the Local Improvement Process are set out in the
Vancouver Charter and the Local Improvement Procedure By-Law. The
projects dealt with in this report have gone through the legal
requirements in the process, but Council has requested additional
information on project support/opposition through reballots before
giving final approval.
PURPOSE
At the June 22, 1995 Court of Revision, Council instructed staff to
reballot two local improvement petition projects.

This has been done and the results are as follows:
Court #568, Item #028, Lane Lighting on the lane south of 36th Avenue
from the lane east of Blenheim Street to Balaclava Street.

Required 2/3 majority 14
Ballot results: In Favour 10
Opposed 7
Responses 17

The three owners who did not return their ballots had signed the
original petition. Even if these owners are assumed to still be in
favour, there is still insufficient support for this project to proceed.
Court #568, Item #043, Pavement and Curbs and Trees on 34th Avenue from
Carnarvon Street to Mackenzie Street.

Ballot results: In Favour 25
Opposed 9
Responses 34
Only one owner did not return their ballot and they had not signed the
original petition. Of the 25 owners in favour of the project, one is
opposed to tree planting. Even if this owner is not included as being
in favour of the project, there is still a two-thirds majority of
support for the project to proceed.
