SUBJECT: Strata Title Conversion: 1846 S.E. Marine Drive
RECOMMENDATION
THAT the application to convert the previously-occupied
building at 1846 S.E. Marine Drive (Lot 2, Block G, D.L.
328, Plan LMP 10151) to strata title ownership be approved
in principle, but that pursuant to Section 9(1) of the
Condominium Act, the Certificate of Approval (Form 10) shall
not be issued unless the following condition has been met
within one year of the date of this approval:
Completion of all work required by the City Building
Inspector, under the required permits, at no cost to
the City, in order that the previously-occupied
principal building substantially complies with all
relevant by-laws.
GENERAL MANAGER'S COMMENTS
The General Manager of Community Services RECOMMENDS
approval of the foregoing.
COUNCIL POLICY
Council Policy is reflected in the City's Strata Title and
Cooperative Conversion Guidelines, which outline factors which
Council will consider in reviewing applications for converting
previously-occupied buildings to strata title or cooperative
ownership.
PURPOSE
Council approval is required for an application to convert the
previously-occupied building at 1846 S.E. Marine Drive (Lot 2,
Block G, D.L. 328, Plan LMP 10151) to strata title
ownership.BACKGROUND
The site is zoned RS-1B and is developed with a principal one-
family dwelling built in 1989, and an infill one-family dwelling
recently completed under Development Permit No. DP215412 and
Building Permit No. BP822595. The infill dwelling has not yet
been occupied.
The owner proposes to create two strata lots in total; the
principal building as one, and the infill dwelling comprising the
other strata lot. The principal building was owner-occupied when
it was purchased by the current owner in May, 1994, and has never
been occupied by tenants. The principal dwelling is also vacant
at this time.
Pursuant to Section 9 of the Condominium Act, Council's approval
is required only as it relates to the previously-occupied
principal building.
The site is shown below in Figure 1.

STAFF ANALYSIS
In addition to Planning Department staff, the City Engineer and
the City Building Inspector have reviewed this application.
Given the nature of this application, the Manager of the Housing
Centre has not been asked to comment.
The City Engineer has no dedication or servicing requirements for
this site.
The City Building Inspector reports that the principal dwelling
must be fully sprinklered, under the necessary permits, in order
for it to substantially comply with all relevant by-laws.
CONCLUSION
Based on the foregoing, and on the applicant's compliance with
the City's Strata Title and Cooperative Conversion Guidelines,
the Associate Director of Planning - Land Use and Development
Division, supports this application.
