Sub-Sublease of City-Subleased Premises – 626 and 636 Powell Street

THAT Council authorize the Director of Real Estate Services to negotiate and execute a sub-sublease (the “Lease”) with Urban Indigenous Health and Healing Cooperative (the “Sub-subtenant” or “UIHHC”) for the City-subleased premises situated at 626 and 636 Powell Street as shown on Appendix A of the Administrative Report dated April 5, 2018, entitled “Sub-Sublease of City-Subleased Premises – 626 and 636 Powell Street”, and legally described as PID 028-345-797, Lot G, Block 52, DL 196, Group 1, New Westminster District, PlanBCP46210 (the “Premises”) on the following conditions:

Term: Five (5) Years, commencing October 1st, 2018

Option to Renew: One (1) option to renew for a further five (5) year term

Lease Area: Approximately 2,760 square foot commercial retail unit

Total Rent: Total rent, inclusive of common area maintenance and building insurance costs (the “Total Rent”) is based on the following rates:

Year 1-2: s.17(1) psf, s.17(1) per annum, s.17(1) per month plus GST;

Year 3: s.17(1) psf, s.17(1) per annum, s.17(1) per month plus GST;

Year 4: s.17(1) psf, s.17(1) per annum, s.17(1) per month plus GST;

Year 5: s.17(1) psf, s.17(1) per annum, s.17(1) per month plus GST.

Total Rent for the five (5) year term is s.17(1) plus GST.

Tenant Allowance: The City as Sub-sublandlord (the “City”) will provide the Sub-subtenant with a tenant improvement allowance of s.17(1) per square foot (s.17(1) inclusive of GST).

Termination Clause: None

Parking: The Total Rent will include the exclusive use of three (3) parking stalls for the UIHHC’s use during the Lease.

Use: A medical clinic with Indigenous focused health and healing centre.

Other Terms and Conditions: The Lease is to be provided on the City’s current standard form of sub-sublease for commercial tenants. Terms and conditions of the Lease are to be drawn to the satisfaction of the Director of Legal and Real Estate Services, it being noted that no legal right or obligation shall arise until the Sub-sublease is fully executed by both parties.

All rents to be credited to the Property Endowment Fund (PEF).
