Appointments to Civic Agencies and Committees

A. THAT Andy Croft be appointed to the Public Art Committee, in the Developer category, term to commence immediately and end December 3, 2017, or until a successor is appointed.

B. THAT Robert Miranda be appointed to the First Shaughnessy Advisory Design Panel, as a Resident Member-at-Large, term to commence immediately and end December 3, 2017, or until a successor is appointed.

C. THAT John Atkin be appointed to the Chinatown Historic Area Planning Committee, as a representative of the Dr. Sun Yat-Sen Garden Society, term to commence immediately and end December 3, 2017, or until a successor is appointed.

D. THAT Stephanie Lim be appointed to the Vancouver Food Policy Council, in the Access and Consumption category, term to commence immediately and end November 4, 2018.

Lease - Premises Located at 511 West Broadway

THAT Council authorize the Director of Real Estate Services to negotiate and execute a lease (the “Lease”) between Broadway Equities Inc. by its duly authorized agent, Triovest Realty Advisors (B. C.) Inc. (the “Landlord”) and the City of Vancouver (the “Tenant”) for the property located at 511 West Broadway legally described as PID: 026-780-071, Lot 1, Block 340, District Lot 526, Group 1, New Westminster District Plan BCP25032, Except Air Space Plan BCP39517 (the “Premises”) as shown in Appendix A of the Administrative Report dated December 1, 2016, entitled “Lease – Premises Located at 511 West Broadway”, on the following general terms and conditions:

Term: Five (5) years from April 1, 2017.

Rentable Area: Approximately 3,230 square feet on the first floor.

Base Rent: Years 1 – 5: s.17(1) per annum (s.17(1) per square foot) plus GST

Operating Cost & Property Taxes: Comprised of a proportionate share of property tax, plus costs for repairs, maintenance, landscaping and supplies, janitorial and recycling, common area utilities, administration and management fees, security, elevator maintenance and repairs, and insurance, estimated to be s.17(1) per annum (s.17(1) per square foot) plus GST for 2017. It is expected these charges will increase by s.17(1) for 2018, and each subsequent year thereafter.

Parking: Not applicable. No additional parking is rented for the lease.

Option to Renew: One (1) option to renew for five (5) years, on the same terms and conditions save and except rent, which is to be negotiated at market rates. If fair market rates cannot be settled by mutual agreement, then the parties may elect to arbitrate the issue to determine the market rental value of the Premises.

Other Terms and Conditions: Such other terms and conditions of the lease are to be drawn to the satisfaction of the Directors of Legal and Real Estate Services, it being noted that no legal rights or obligations shall arise or be created until the lease document is fully executed by both parties.

Tentative Settlement of 2016-2019 Collective Agreements between the City of Vancouver and CUPE Local 15


THAT the Memorandum of Settlement for Collective Agreements covering employees represented by the CUPE Local 15 for the period of January 1, 2016 to December 31, 2019 be approved.

Lease of 390-394 Powell Street for the Homeless Outreach Team


THAT Council authorize the Director of Real Estate Services to negotiate and execute a lease (the “Lease”) with Provincial Rental Housing Corporation (PRHC) (the “Landlord”) for the City’s Homeless Outreach Team (the “Tenant”) on the land and buildings situated at 390, 392 and 394 Powell Street legally described as PID: 029-094-712, Lot 1 Block 55 Plan EPP31241, District Lot 196 NWD Group 1 (the “Subject Property”), as shown on Appendix A of the Administrative Report dated December 2, 2016, entitled “Lease of 309-394 Powell Street for Homeless Outreach Team”, on the following terms and conditions:


Term: Five (5) years, anticipated commencement date October 1, 2017.


Leasable Area: Approximately 3,312 square feet (the “Premises”).

*For the purpose of projecting property taxes and operating costs, an annual increase of 2.5% is assumed.


Operating costs include: water and sewer, waste and recycling removal, general cleaning for the common area, snow removal, pest control, common area utilities, repair and maintenance of common area, management fees and insurance.


Possession Date: The earlier of: i) issuance of a building permit for tenant improvements by the City of Vancouver; or ii) June 30,
2017.


Commencement Date: Commencing on the day following expiry of the Fixturing Period, as herein defined.


Fixturing Period: The Tenant will be granted a Total Rent free period of s. 17(1), commencing on the Possession Date to install its tenant fixtures and leasehold improvements.


Improvement Allowance: Landlord will provide the Tenant with an improvement allowance of s. 17(1), per square foot) plus GST, to assist with tenant fixturing.


Use: Homeless Outreach Office


Option to Renew: One (1) – five (5) year renewal option on the same terms and conditions, except the Rent which is to be set as follows:

Indemnity: The Tenant will be required to indemnify and save harmless the Landlord from and against any and all losses and claims (including those related to damage to property or personal injury, including death) arising from the Lease, any occurrence upon the Premises, or occupancy or use by the Tenant of the Premises, or caused by any act or omission of the Tenant or its assignees, agents, invitees or licensees.

Other Terms And Conditions: The Lease is to be provided by the Landlord. Terms and conditions of the Lease are to be drawn to the satisfaction of the Directors of Legal and Real Estate Services, it being noted that no legal right or obligation shall arise until the Lease is fully executed by both parties.

The funding source is from the Annual Community Services Operating Budget.
