Nomination for Civic Merit Award – Fred Mah

THAT Fred Mah be granted the Civic Merit Award.

Appointments to Civic Agencies and Committees

A. THAT Kim Maust be appointed to the Development Permit Board Advisory Panel as the Vancouver Heritage Commission representative, term to commence immediately and end December 1, 2013.

B. THAT Michael Kluckner be appointed to the First Shaughnessy Advisory Panel as the Vancouver Heritage Commission representative, term to commence immediately and end December 1, 2013

C. THAT Phil Mondor be appointed to the Urban Design Panel as the Vancouver City Planning Commission representative, term to commence immediately and end December 7, 2014.

D. THAT Alan Davies be appointed to the Gastown Historic Area Planning Committee, term to commence immediately and end December 1, 2013.

E. THAT Goran Ostojic be appointed to the Urban Design Panel, representing the Association of Professional Engineers and Geoscientists of British Columbia, term to commence immediately and end December 7, 2014.

Tentative Settlement of the 2012-2015 Collective Agreement between the Vancouver Police Board and Teamsters Local 31

THAT the Memorandum of Agreement for a Collective Agreement covering civilian employees of the Vancouver Police Department represented by the Teamsters Local 31 for the period of January 1, 2012 to December 31, 2015, be approved.

The relevant report remains sensitive and cannot be released.

 

Property Acquisition for the Powell Street Grade Separation Project – 1100 Powell Street

A. THAT Council approve the purchase of 1100 Powell Street, legally described as Parcel Identifier: 015-684-423, Lot 17, Except Part In Plan LMP29960 of Lot 2 Block K District Lot 182 Group 1 New Westminster District Plan 176 (the “Subject Property”) from Benrose Holdings Limited, for a purchase price of s. 17(1) (d) (e) & (f) and s. 21(1); it being noted that no legal right or obligation is hereby created, and non shall arise, until all legal documentation is fully executed on terms and conditions satisfactory to the Directors of Real Estate and Legal Services.

B. THAT Council approve funding of s. 17(1) (d) (e) & (f) and s. 21(1) to remediate the known contamination on the Subject Property and pursue a Certificate of Compliance, and if required, conduct further site investigations, prepare a remediation plan and site remediation for the surplus portion of the property not required for road purposes.

Funding for the purchase and the soil remediation to be provided from CER-00117-11-AA within the Approved 2012 Engineering Capital Budget.

Approval of Financial Contribution to British Columbia Housing Management Commission for Tenant Improvements and Operating Funding for the provision of 100 units of Transitional Housing at 395 Kingsway (site currently known as the Howard Johnson Plaza Hotel)

A. THAT Council authorize the City Manager to enter into an agreement (the “Contribution Agreement”) with British Columbia Housing Management Commission (“BC Housing”) to set out the respective roles and responsibilities of the City and BC Housing with regard to a lease (the “Lease”) for a term of six (6) years (together with three (3) renewal options of three (3) years each) between 636608 B.C. LTD. (the “Landlord”) and BC Housing (as the “Tenant) for a portion of the property known as Howard Johnson Plaza Hotel, situated at 395 Kingsway, legally described as PID 008-628-360, Lot 2, Block 116, District Lot 301, Plan 10979, which portion of the property is shown outlined in bold on the plan attached as Appendix A to the Administrative Report dated January 23, 2013, entitled “Approval of Financial Contribution to British Columbia Housing Management Commission for Tenant Improvements and Operating Funding for the provision of 100 units of Transitional Housing at 395 Kingsway (site currently known as the Howard Johnson Plaza Hotel)”(the "Premises"). The Contribution Agreement will state that the City will provide a contribution to BC Housing of s.17(1) for tenant improvements (the "Tenant Improvements") at the Premises, which Contribution Agreement will be satisfactory to the City Manager and the Director of Legal Services, and will include the following:

i. BC Housing will take the lead and be responsible for coordinating and managing the tenant improvement project scope of work, provide project oversight, manage trades, procure supplies, equipment, and materials, and will coordinate final construction deficiencies and warranties;


ii. BC Housing will consult with the City on the selection of the non-market housing sponsor selected to operate the Premises (the “Operator”); and


iii. the City, BC Housing, and the Operator will agree on the tenant mix for the Premises on the basis of the 50/30/20 model, where 50% of the rooms go to residents of Vancouver who are street or sheltered homeless, 30% to people in Vancouver who are "in transition" (which may include SRO residents), and 20% for people in Vancouver who are "at risk of homelessness".

B. THAT upon approval of A, Council approve a one-time funding contribution of s. 17(1) to BC Housing for the Tenant Improvements, with the source of funding to be Capital from revenue funding allocated in the 2012-2014 Capital Plan for new non-market housing (grants); s. 17(1).


C. THAT Council approve an annual operating funding grant for each year of the Lease, including any renewal terms, to the Operator, equivalent to the amount of the City’s general purpose tax levied on the housing project (the “City’s Tax Portion”) as outlined in this report, subject to the Premises continuing to be used to provide transitional housing and associated support services to the residents in accordance with the terms and conditions outlined in the Contribution Agreement; source of funding to be the Annual Operating Budget.
