Appointments to Civic Agencies and Committees

A. THAT the following individuals be appointed to the Urban Design Panel, representing the agencies and categories indicated, terms to commence December 3, 2012 and end December 7, 2014, or until successors are appointed:

Award of RFEOI and Lease of City-owned Property Situated at 281 Industrial Avenue to Great Northern Way Scene Shop and Arts Factory Society

A. THAT Council authorize the Managing Director of Cultural Services to award to Great Northern Way Scene Shop and Arts Factory Society as the successful proponent to a city-issued Request For Expressions of Interest (RFEOI) to lease City-owned premises located at 281 Industrial Avenue (see Appendix “A” to the Administrative Report dated November 23, 2012, entitled “Award of RFEOI and Lease of City-owned Property Situated at 281 Industrial Avenue to Great Northern Way Scene Shop and Arts Factory Society”) to operate as multiple, affordable, accessible artist studios and production spaces, subject to the terms and conditions set-out in C.


B. THAT Council authorize the Director of Facilities Planning and Development to tender and approve the awarding of construction contracts in the amount of $1,762,000 for the purpose of Capital Maintenance Costs to the City-owned building at 281 Industrial Avenue in order to undertake base building repairs and maintenance required to provide a safe and secure facility in which the Tenant can undertake its Tenant Improvements and operate safely from for the next ten (10) years. The source of funding for the Capital Maintenance Costs is the Property Endowment Fund (PEF).


C. THAT Council authorize the Director of Real Estate Services to negotiate and execute a lease (the “Lease”) with Great Northern Way Scene Shop and Arts Factory Society (the “Tenant”) for City-owned premises situated at 281 Industrial Avenue (the “Premises”) legally described as Lots 34 to 40, Block A2, District Lot 2073, Plan 7419, NWD, on the following terms and conditions:


Term: Ten (10) years, commencing June 1, 2013

Rent: The rent, inclusive of property taxes, is to be set as follows:
Years 1-5: $157,710 per annum ($7.50 psf) plus applicable HST.
Years 6-10: $178,738 per annum ($8.50 psf) plus applicable HST.

Fixturing Period: The Tenant shall receive a four (4) month rent free fixturing period, commencing February 1, 2013 and ending May 31, 2013, to construct its tenant improvements. During this period the Tenant will be responsible for maintaining insurance coverage, and the payment of all utilities.

Free Rent Period: The Tenant shall receive a three (3) month rent free period, commencing June 1, 2013 and ending August 31, 2013, to support a phasing in of the demised artist studio spaces. During this period the Tenant will be responsible for maintaining insurance coverage, and the payment of all utilities.


Use: The premises are to be used as an Industrial Artists Studios and Shared Production Space plus ancillary business offices.

Other Terms and Conditions: The Lease is to be provided on the City’s Standard Lease Agreement, drawn to the satisfaction of the Directors of Legal and Real Estate Services, it being noted that no legal right or obligation is created and none shall arise until the Lease document is fully executed by both parties.
