Tripartite License Agreement between the City of Vancouver, the Parking Corporation of Vancouver, and Local Garden Vancouver Inc., for City-owned property at 523/535 Richards Street
THAT Council authorize the Director of Real Estate Services to negotiate and execute a tripartite license agreement for urban gardening on the rooftop of the City-owned property located at 523/535 Richards Street, legally described as PID’s: 015-488-705; 015-488-713; 015-488-764; 015-488-772; 015-488-781; 015-488-799; Lot s 11 to 16, Block 34, District Lot 541, Plan 210, to Local Garden Vancouver Inc. from the City of Vancouver and the Parking Corporation of Vancouver (dba EasyPark) on the following terms and conditions:
Term: Ten (10) years with two consecutive Five (5) year options to renew
License Area: The rooftop of the parkade is a split level (two levels). The licensee has the option of licensing either one level or two levels.
License Fee: s. 17(1) (d) (e) & (f) and s. 21(1)
Termination
Liability: s. 17(1) (d) (e) & (f) and s. 21(1)Other Terms
& Conditions: The license agreement is to be drawn to the satisfaction of the Directors of Legal Services and Real Estate Services, it being noted that no legal right or obligation is created and none shall arise until the license agreement is fully executed by both parties.

Lease Renewal at 2772-2774 East Broadway - The City of Vancouver and Westcoast Child Care Resources Centre
THAT Council authorize the Director of Real Estate Services to negotiate and execute a lease renewal with Westcoast Child Care Resources Centre (the “Tenant”) for the City owned premises located at 2772–2774 East Broadway, legally described as Parcel Identifier: 009-551-581, Lot 2 Block 1, 4, 5, & 8, Section 35 S HLF District Lot THSL Plan 9744 (shown in Appendix A of the Administrative Report dated July 20, 2012, entitled “Lease Renewal at 2772-2774 East Broadway - The City of Vancouver and Westcoast Child Care Resources Centre”), on the following terms and conditions:
Term: Five (5) years commencing July 1, 2012
Rent: s. 17(1) (d) (e) & (f) and s. 21(1)
Permitted
Use: Family resource centre and commercial officeLeaseable
Area: 7,264 square feetEarly
Termination: The Landlord may terminate the lease upon giving twelve (12) months prior written notice of such termination, as provided in Section 1.2 of the lease. There will be no compensation payable to the Tenant in the event the Landlord exercise its right of early termination.Other terms and
Conditions: The lease renewal is to be provided on the City’s Standard Lease Renewal document drawn to the satisfaction of the Directors of Legal Services and Real Estate Services, it being noted that no legal rights or obligations shall arise or be created until the lease renewal document is fully executed by both parties.Rent to be credited to the Property Endowment Fund (PEF).

Verbal Briefing – Powell Street Overpass Update
Penny Ballem, City Manager, and Peter Judd, General Manager of Engineering Services, presented an update on key issues regarding the Powell Street Overpass project, and responded to questions.

THAT City Council endorse the appointment of Ms. Janice MacKenzie, as recommended by the City Manager and Selection Committee, for the position of City Clerk.
