Lease of City-owned property situated at 458 West Broadway to Hsuen Kun Chow

THAT Council approve a lease to Hsuen Kun Chow for the premises situated at 458 W Broadway, legally described as Lot A (Explanatory Plan 5498), Block 360A, District Lot 526, Plan 1277, and as denoted in Appendix A, on the following terms and conditions:

Term: Three (3) years commencing January 1, 2011

Gross Rent: The gross rent, inclusive of water and heating charges, and an amount in lieu of property taxes, to be set as follows:

Jan 1, 2011 to June 30, 2011 - [ ... ] per annum [ ... ] plus appropriate taxes
July 1, 2011 to June 30, 2012 - [ ... ] per annum [ ... ] plus appropriate taxes
July 1, 2012 to June 30, 2013 - [ ... ] per annum [ ... ] plus appropriate taxes
July 1, 2013 to Dec 31, 2013 - [ ... ] per annum [ ... ] plus appropriate taxes

Use: The premises are to be used for grocery retailing and related food services

Sublease Assignment: Tenant must seek prior written consent from the Landlord prior to assigning the lease in whole or in part or subleasing the Leased Premises or any part of the Leased Premises or granting any concession or license of any part of the Leased Premises. In consenting to any request for assignment, sublease, concession or license, the Landlord has the right to add any additional terms and conditions to the lease or modify the terms and conditions of the lease, at its own discretion and to its sole satisfaction.

Profit Rent: Any profit rent generated from assignment, sublease, concession or license of the Lease premises is to be paid to the Landlord.

Other Terms and Conditions: All other terms and conditions are to be similar to the current lease. The lease document is to be drawn to the satisfaction of the Director of Legal Services. No legal right or obligation is hereby created and none shall arise until the lease document is signed by both parties.

Recruitment of General Manager, Human Resource Services

Penny Ballem, City Manager, introduced Lisa Kershaw, Odgers Berndtson, a consultant retained to assist with the recruitment of a new General Manager of Human Resource Services. Dr. Ballem reviewed the primary roles of the General Manager and asked for Council feedback in regard to the recruitment of a prospective candidate.
