Lease of 3595 East 1st Avenue for parking by the Vancouver Police Department (“VPD”)

A. THAT Council authorize the Director of Real Estate Services to enter into a lease of 3595 E. 1st Avenue (the “Lot”), legally known as Lot A, Except Part in Plan 22684, Block 113, Sections 28 and 29, THSL, Plan 17192, PID:011-185-015, as shown heavily outlined on Appendix A to the Administrative Report dated October 18, 2010, entitled “Lease of 3595 East 1st Avenue for parking by the Vancouver Police Department (“VPD”)”, subject to the following general terms and conditions:

Term: Four Years and Eleven Months commencing December 1, 2010.

Use: Parking of motor vehicles for VPD staff.

Early Termination: Both the Landlord and the Tenant shall have the right of early termination upon providing the other party with six months advance written notice. Neither party may serve notice of termination prior to October 31, 2011.

Other Terms and
Conditions: The Lease is to be provided by the Landlord and drawn to the satisfaction of the Director of Legal Services and the Director of Real Estate Services and the Chief Constable of the Vancouver Police Department.

No Legal Right or obligations is hereby created and none shall arise until the lease document is fully executed by both parties.

Source of funding to be the existing VPD operating budget.

B. THAT Council authorize the installation of three security gates estimated at $75,000. The cost is to be funded from the VPD Transition Fund.

Appointment of Chief License Inspector

THAT Council appoint Mr. Will Johnston, P.Eng., as the City’s Chief License Inspector.

THAT Council approve the following recipients for the 2010 Cultural Harmony Awards:

South Vancouver Neighbourhood House ‘Organization’ Award

Leila El-Khatib ‘Individual’ Award.

Reappointment of City Representatives to the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (“VANOC”)

A. THAT Council reappoint Dr. Penny Ballem and Jeff Mooney as the City of Vancouver’s two members/directors of VANOC pursuant to VANOC By-law No. 1, (including participating in any committees of VANOC), for the term commencing November 17, 2010 until February 28, 2011.

B. THAT Dr. Penny Ballem, City Manager, be designated by the City of Vancouver as the City’s “Designated Appointee” for the purpose of certain votes by members or directors pursuant to VANOC’s By-law No. 1.

C. THAT Jeff Mooney be designated by the City of Vancouver as the City’s “Alternate Designated Appointee” to act in the event of the Designated Appointee’s absence or inability to act, for the purpose of certain votes by members or directors pursuant to VANOC By-law No. 1.

D. THAT Dr. Penny Ballem’s participation in VANOC, as one of the City of Vancouver’s two members/directors of VANOC, be deemed to be included in the performance of her duties as City Manager for the purposes of the Liability Indemnification By-law (By-law No. 6579).

E. THAT the terms of the Appointment Agreement dated for reference as of April 30, 2006 between the City of Vancouver and Jeff Mooney remain in full force and effect for as long as Jeff Mooney remains one of the City’s two current members/directors of VANOC.
