Appointment of Deputy Chief Building Official
THAT Council appoint Mr. Pat Ryan, P.Eng., as the Deputy Chief Building Official (Permitting) effective immediately.
THAT Council appoint Mr. Kandiah Pavananthan, P.Eng., as the Deputy Chief Building Official (Permitting) during Mr. Ryan’s absence from August 1, 2010, to September 7, 2010.

Lease Renewal for City-owned Premises situated at 1401 Hornby Street to Wimco Nurseries Ltd. (Art Knapp Urban Centre)
THAT Council approve a lease renewal for the premises situated at 1401 Hornby Street legally described as Lots 30, 31 and a portion of Lot 32, Block 120, District Lot 541, Plan 210 to Wimco Nurseries Ltd. on the following terms and conditions:
Term: Five (5) years commencing June 1, 2010;
Option to Renew: n/a
Premises: The leased premises occupy an area of approximately 10,568 sq.ft. comprised of the following:
Main Floor 7,620 sq.ft.
Mezzanine 2,948 sq.ft.
Total Rentable 10,568 sq.ft.
Plus Outside Yard 1,920 sq.ft.Use: retail / garden centre space;
Gross Rent: [ … ]
Parking: Six (6) parking stalls paid to EasyPark over and above the base rent;Maintenance: Tenant is responsible for all repairs and maintenance excluding structural;
Structural: Landlord is responsible for structural maintenance of the leaded premises including maintenance and roof repairs;
Early Termination: Either party may terminate the lease upon providing twelve (12) months prior written notice of cancellation.
All other terms contained in the City’s Standard Lease Agreement all to be drawn to the satisfaction of the Directors of Legal and Real Estate Services; it being noted that no legal right or obligation is created and none shall arise hereafter until the execution of the lease documents.
All rents to be credited to the Property Endowment Fund (PEF).

Project Funding – By-law Adjudication Project
A. THAT Council approve, in principle, the establishment of a By-law Dispute Adjudication System.
B. THAT Council approve $873,000 for the design and development work needed to implement a by-law adjudication system and that the funding be provided from the Capital Financing Fund on terms acceptable to the Director of Finance.

Potential Sale of City-owned land located at 1412-1450 Howe Street and 1429 Granville Street and proposed closure and sale of adjacent lane
A. THAT Council authorize the Director of Real Estate Services to enter into exclusive negotiations with the owner of 1460 Howe Street, Howe Street
Ventures Ltd. (Westbank) over the next 12 months for the sale to Westbank of the City owned lands at 1412-1450 Howe Street, 1429 Granville Street and portion of lane all as legally described in Appendix A of the Administrative Report dated July 19, 2010, entitled Potential Sale of City-owned land located at 1412- 1450 Howe Street and 1429 Granville Street and proposed closure and sale of adjacent lane (the Subject Lands) and provided that the City obtain a price reflecting premium assembled market value for the Subject Lands;FURTHER THAT, if the Director of Real Estate Services can successfully conclude such negotiations with Westbank, Council authorize the Directors of
Legal and Real Estate Services to enter into a legally binding Contract of Purchase and Sale, such sale being subject to the Subject Lands being rezoned,
and subject to Council approval;AND FURTHER THAT, no legal rights or obligations will arise or be created between Westbank and the City unless and until a legally binding Contract of
Purchase and Sale is successfully negotiated and executed and delivered by Westbank and the City through its authorized signatories, the Director of Legal
Services and the Director of Real Estate Services and approved by Council.B. THAT Council authorize the Director of Real Estate Services to undertake all necessary site investigations and preparations relating to the sale of the Subject
Lands; including environmental, hazardous material and geotechnical assessments, site surveys, appraisals and consultants fees with a total budget
cost of s.17(1). Source of funding being the Property Endowment Fund.C. THAT, if the Director of Real Estate Services is at any time during the 12 month negotiation period of the view that terms cannot be successfully concluded with
Westbank, the Director of Real Estate Services report back to Council for further direction.
